SLAUGHTER William KEPINGER ---------------------------- On motion of Abner HYNES by his attorney It is ordered that upon his entering into bond with security at the next County Court as the law directs that a ferry be established in his favor across the rolling fork at the mouth of the Beech fork _____ having derived ____ to the lands on both sides of the river from Andre HYNES deceased ---------------------------- Commonwealth on summons to shew cause why the vs administration of her husbands estate Ann REED should not be taken from her. Ordered that this cause be continued untill the next Term of this Court ---------------------------- Present Jacob ENLOWS Christopher MILLER and Joseph STITH Esquires --------------------------- On petition of sundry persons It is Ordered that William VERTREES Shadrick BROWN Henry MARTENBURGH James LAWSON & William L. BEAVER or any three of them being first sworn be and they are hereby appointed to view the nearest and best way for a road to be opened from OVERTONs mill on Otter Creek to the Ohio River near the mouth of said creed & make report to court as the law requires -------------------------- Ordered that Greenberry A. GAITHER Danl WAID & Benjamin HELM be and they are hereby appointed commissioners to make such repairs to the courthouse as they may think proper & that an allowance will be made at the laying the next levy for said repairs ----------------------------- Jacob ENLOW & Christopher MILLER & Robert C. SLAUGHTER are hereby appointed Judges to the ensuing election for to be held in at the Courthouse & Jacob ENLOW clerk to said election. POTTER and Soloman QUERY be and they hereby recommended to the governor for the time being as proper persons to fill the office of coroner in this County in place of Samuel STEVENSON esq who has resigned his commission ------------------ On motion of Augustan GREEN esq & Charles McCORMICK attorneys in fact for Thomas ST[blot] and on motion of James COLMAN as adm of Thomas CARNEAL decd It is ordered that Benjamin HELM Joseph STITH Joseph WOOLFOLK Henry DITTO Sen and William WITHERS Sen or any tow of them are hereby appointed commissioners to divide several certain tracts of land lying in Hardin County on Otter Creek which is held in partner ship between said Thomas SLRODE and said Thomas CARNEALs heirs & ______ of the six comm. for the division of land under the ____ of ____ representatives and it is further ordered the motion of said James COLMAN that Benjamin HELM be and he is hereby appointed guardian to Thomas COLMAN Infant son of said James COLMAN & Sally his wife who was Sally CARNEAL to superintend the division of the land above mentioned ------------------------- The last will and Testament of Richard ATTERBURY was proven by the Oath of Priday CHEEKS and held over for further proof and that a summons issue for _____ WRIGHT to prove said will ---------------------------- Ordered that Joseph THOMAS be and he is hereby appointed surveyor of the public road from Shaws Creek to the _____ branch of Roos Creek in place of John SNEED and that all the hands that assisted said SNEED do assist said THOMAS in keeping the said road in repair --------------------------------- William BAYNE produced in Court the commission from under the hand of his excellency Isaac SHELBY Governor of Kentucky appointing him a Justice of the peace in and for the County of Hardin with the following Certificate thereon endorsed (towit) Hardin County Sct This day came William BAYNE before me George HELM Justice of the peace for the County aforesaid and took the several oaths prescribed by law and Oath of office agreeable to the within Commission and the Oath prescribed by law to suppress the practice of duelling in the Commonwealth given under my this 29th day of April 1813 Geo HELM -------------------------------- The Commissioners appointed to establish the Beginning and special calles of four entries towit one in the name of George WALTON for 1818 acres one in the name of William HENRY of 300 acres one in the name of William FERRILL of 400 acres and one in the name of George WALTON of 2382 acres, This day reported the Deposition of ______ RIGG James SKAGGS Charles AMOS & John COY which were ordered to be entered of Record ----------------------------- On motion of Lewis WELLS sheriff of the County John MYERS is admitted as his Deputy whereupon the said John MYERS took the several oaths required by law ---------------------------- Present William BAYNE, Esquire -------------------------- Ordered that a summons issue to the sheriff of Grayson against Nancy SMITH returnable to next Court to shew cause if any she can why the administration of her husbands estate should not be taken from her. ------------------------- The processioners of the middle District made report of 300 acres of land processioned for Jacob LARUE which report was ordered to be entered of Record ------------------ Commonwealth to shew cause why the vs administration of Richd REGON, BLESSETE & others ATTERBURYS estate should not be taken from them Ordered that this cause be and It is hereby continued untill the next Term of this Court ------------------------ Ordered that the following hands (to wit) Jesse KEITH William KEITH Adin BRASHEAR John WHITMAN John BLAKE Wilson BOMER William FREEMAN Gideon RAGLIN Joseph RAGLIN Robert RAGLAND and ALexander WILLIAMS & Elijah CONSTANCE do assist Henry COUTS in keeping the road in repair of which he is surveyor. -------------------------- Ordered that William Brownfield Senr Lewis DUFFY William DUNN Alexander McDOUGHEL & Ambrose GEOGHEGAN be summoned to appear at the next court to shew cause if any they have for failing to give in their taxable property to Squire LARUE commissioner appointed for Capt Coonrod WALTERS Company for 1812 on the information of Lewis WELLS esq Sheriff of this County under and act of assembly for such cases made & provided --------------------------- On motion of George McLEAN esq be appointed guardian to Sally McLEAN infant orphan of Leonard McLEAN deceased whereupon the said George McLEAN entered into and acknowledged his bond in the penalty of one thousand dollars with Lewis WELLS Samuel PERCEFULL & John MYERS his securities conditioned as the law directs --------------------------------- Alexander WILLIAMSON appellant on an appeal against from a magistrates Philip JINKENS appellee Judgment This day came the parties by their attornies and the argument of the counsel on both sides being heard and duly considered by the Court It is the opinion of the Court that this appeal be ____. STEVENSON appellant on an appeal from vs magistrated Judgt John ECCLES Ordered that this appeal be and the same is laid over till to morrow morning ---------------------------- Ordered that Joseph THOMAS be and he is hereby appointed Surveyor of the road leading from Shaws Creek to the Eastern branch of Roods Creek and that all the hands in the following bounds (towit) Beginning at the said Joseph THOMAS' including all the lands on Billip Creek as low down as John VANMETERs old place including it thence to Noah SMITHS including Thomas GEOGHEGAN's old place thence up o____ Creek to the forks of the road from thence to the Beginning do assist said THOMAS in keeping said road in repair ----------------- On motion that Court be adjourned till to morrow morning 8 oclock C. MILLER ==================================== Tuesday July 13th 1813 The Court met according to adjournment -------------------- Present Adin COOMBS Joseph STITH and Christopher MILLER Esquires --------------------- Ordered that the order entered up herein on yesterday against Ambrose GEOGHEGAN for failing to give in a list of his taxable property be and the same is hereby recinded --------------------- Ordered that Micajah GORTNEY be and he is hereby appointed surveyor of that part of the road leading from Elizabeth Town to WOODSONs ferry which lies between the south fork of Nolins and the intersection of the old road leading from BRASHEARs in place of James McMURTRY and that all the hands that did assist said McMURTRY do assist said GORTNEY in keeping said road in repair -------------------------------- John A. STEVENSON appellant on appeal from against Judgment of a John ECCLES magistrate This day came the parties by their attornies and the cause being fully argued by the counsel on both sides and duly considered by the Court It is the opinion of the Court that the magistrates Judgment be and the same is hereby reversed and set aside. And that the appellant recover against the appellee his costs by him about his appeal in this behalf expended and the said appellee in mercy ------------------------------- Jacob VANMETER claims two days attendance for Defendant ----------------------- It appearing to the satisfaction of the Court that Samuel STEVENSON is improperly charged with a retail store for the year 1812 which he had not on the 10th day of March 1812. It is therefore ordered by the Court that the sheriff have credit for the same and that the sheriff of Hardin County have credit for the same in his settlement with the auditor of public accounts -------------------------- Ordered that all the hands in the following bounds to wit Beginning at John STITHs thence down Otter Creek to John GOATLY including William & James ALLEN and John STITH Jun thence up Otter Creek including all the hands therein to the Beginning do assist William B. STITH in keeping the road in repair of which he is surveyor ---------------------- Ordered that the order entered up herein on yesterday ordering a summons to issue against Alexander McDOUGLE for not giving in his taxable property be and the same is hereby recinded ----------------- Ordered that Benjamin IRWIN be and he is hereby appointed surveyor of the road leading from Elizabeth Town to the mouth of salt river which lies between the sign post near Elizabeth Town at the fork of the road and the forks of the road the other side of Hardin THOMAS' where the road to Brandenburgs ferry takes off and that all the hands that assiste said THOMAS former surveyor do now assist said IRWIN in keeping said road in repair ---------------------------- Ordered that Lemuel ENGLISH, John SHACKLEFORD Nathaniel LINDER Jacob VANMETRE Thomas SHACKLEFORD and Michael NICHOLS be and they are hereby appointed Patrollers in this County and John SHACKLEFORD I appointed Captain to said Patroll ------------------------------- Ordered that Greenbury A.
