DORSEY a subscribing witness thereto and sworn to by Charles ATTURBURY and Richard ATTURBURY the Executors named in said will who took upon themselves the Executors thereof whereupon they entered into and acknowledged their bond with Reason BLESSIT their security in the penalty of six hundred Dollars conditioned as the law directs they having taken the oath required by law. ----------------------- on a Motion of Moses HART It is ordered that Aaron TERRY Jasper TERRY Thomas HART and James HAYCRAFT be and they are hereby appointed viewers to view an alteration proposed to be made on the rock creek road to leave the old road at Nebo nob and Intersect the Hartford road at about one mile distance and that they make report to next Court. --------------------- Ordered that James HAYCRAFT be and he is hereby appointed surveyor of that part of the road which lies between Levi HALLs and the pond about five miles from said HALLs on the Hartford road and that the following hands (towit) Elias BROWN, Daniel LINDER Jacob LINDER, John A. STEVENSON, Martin HARDIN, Levi HALL, Frederick SETSER John SETSER James GILLELAND Jesse MORGAN James FORTENBURY do assist said HAYCRAFT in keeping said road in repair ----------------------- Ordered that Moses HART be and he is hereby appointed surveyor of that part of the Hartford road which lies between the pond about five miles from Levi HALLs and SOUDERs and that the following hands towit James GRAYHAM John CARSON Segnior John Carson Jun Mathias GRAYHAM Lewis GREENAWALT Joseph GREENAWALT Anthony GREENAWALT John GREENAWALT Samuel CARTER, John GRIMES Luke GREENAWALT and Malon HATFIELD do assist said HART in keeping said road in repair -------------------- Absent George HELM Esquire -------------------- Present Adin COOMBES and James YOUNG Esquires ----------------------- Commonwealth on summons to shew cause why against he should not be fined & treble taxed Lewis DUFFY for failing to give in a list of his taxable property for 1812 This day came the Defendant and made his excuse and for reasons appearing to the Court It is ordered that his list of property be reviewed and placed on the book to be made out by ___ clerk and that the said DUFFY pay twenty five percent on the amount of his ______________ ---------------------- The last will and Testament of Isaac WOOD was produced in Court and proven by the oaths of Richard J. MUNFORD and John WILSON to be the act and Deed of said WOOD and sworn to by William WOOD Lewis WOOD and Jesse WOOD the Executors therein named who took upon themselves the Executors thereof whereupon they acknowledged their bond with Jonathan BOLLING and John FARGUSON their securities in the penalty of eight thousand dollars conditioned as the law directs. --------------------- Ordered that Thomas MUNFORD Richard MUNFORD Dudley ROUNDTREE Arthur McGAUGHY Jun and Frederick M___ or any three of them do after being sworn before any magistrate of this county appraise the personal estate and slaves (if any) of Isaac WOOD deceased and that they make report to the Court -------------------- The last will and testament of John RICE was produced in Court duly authenticated from the State of Maryland was received and ordered to record --------------------- Ordered that Jacob SWANK William BURK John SLATER & John SMITH or any three of them is hereby appointed to view an alteration proposed to be made in the road leading from Elizabeth Town to Thomas JOHNSTONS ferry on the Rolling fork and that after being sworn to make report to Court -------------------- Ordered that Samuel MARTIN John KENNEDY Coonrod WALTERS Senr & George RUST being first sworn before a Justice of this county or any three of them do view an alteration in the road leading from Elizabeth Town to Mrs HODGENs mill to leave the old road about the fork that gose by William BUZANs and to intersect the old road again in the big grove and report to Court the inconveniences of the present road & the proposed alteration & report the same to the Court ------------------ Col. Nicholas MILLER & George HELM are hereby appointed to settle with Denton GEOGHEGAN as guardian of Elizabeth GEOGHEGAN & return the settlement to Court ------------------------ Nicholas MILLER & Robert BLEAKLEY are hereby appointed to settle with Charles HELM as guardian of Charles McINTIRE and return the settlement so made to Court -------------------- Commonwealth To shew cause why the against administration of her husbands Ann REED estate should not be taken from her Ordered that this cause be and the same is hereby continued untill the next Term of this Court ----------------------- same To shew cause why he should vs not be fined and treble taxed William BROWNFIELD for not giving in a list of his taxable property for the year 1812 ----------------------- same vs same William DUNN This day came the Defendants in the two above cases and made their excuses and for reasons appearing to the Court It is ordered that they give a list of their taxable property for the year 1812 to the Clerk of this Court whose duty it shall be to place the same on the book to be made out by him and It is ordered that ___ said Defendants pay twenty five per cent on the amount _____ for said year -------------------- Ordered that Thomas OVERALL be and he is hereby appointed surveyor of that part of the road which lies between the red oak grove and Otter Creek on the Hardinsburg road and that all the hands on SHAWs Creek above Christopher MILLERs at John PANTs old place all the hands on George HOWARDs old place and all the hands at the Andrew WATTS place and all other hands near said road and who are not included in the bounds of any other surveyor do assist said OVERALL in keeping said road in repair. ---------------------- Ordered that Elias DRURY be and he is hereby appointed surveyor of that part of the road leading from Elizabeth Town to Denton GEOGHEGANs mill which lies between the boundaries of John SNEED and the forks of the road near said GEOGHEGANs mill and that John HARVEY John McCULLUM John DOUGHERTY Jesse DOUGHERTY Corteny SYMZ James PURCEL John RIDGWAY and George CLINGINGSMITH do assist said DRURY in keeping said road in repair ---------------------- Samuel PERCEFILL appellant on an appeal against from a magistrates John ROUSE appellee Judgment This day came the parties by their attornies and their cause being argued by the council on both sides and duly considered by the Court, It is the opinion of the Court that the magistrates Judgment be and the same is hereby set aside and that the appellant recover against the appellee the sum of five Dollars --- --- Also the sum of two Dollars twelve and a half cents his costs expended before the magistrate also his costs by him about this appeal expended and the said Defendant may be taken -------------------------- same vs same, Robert DUN Senr claims one days attendance for plaintiff ---------------------- same vs same, Richard CRAIL claims one days attendance for plaintiff ----------------------- same vs same, William DUN claims one day attendance for same ----------------------- same vs same Lewis WELLS claims one days attendance for same ---------------------- Charles HELM Paymaster of the 3rd Regiment of Kentucky Militia on motion to recover against amount of Militia Fines Benjamin WRIGHT L D H O listed with him Ordered that this motion be and the same is hereby dismissed and that the Defendant recover against the plaintiff his costs by him about his defence herein expended --------------------------------- Same against same Nicholas MILLER Ordered that this motion be and the same is hereby dismissed and that the Defendant recover against the plaintiff his costs by him about his defence herein expended. ------------------------------- same against same Squire LARUE Ordered that this motion be and the same is hereby dismissed and that the Defendant recover against the plaintiff his costs by him about his defence herein expended. --------------------------- Charles HELM, paymaster of the 3rd to recover militia Regiment of Kentucky Militia fines listed with him against Nicholas MILLER Ordered that this motion be and the same is hereby dismissed and that the Defendant recover against the plaintiff his costs by him about his defence herein expended ------------------------------ Same against same No 1 George HELM ----------------------------- Same same No 2 against same ------------------------ Same same No 3 against same ----------------------- same same No 4 against same Ordered that the four above motions be and they are hereby dismissed and that the Defendant recover against the plaintiff his costs by him about his defence therein expended ------------------------- Ordered that Court be adjourned till Court in Course C.
