COURT ORDER BOOK C PP 35 - 39 Monday, October 12th 1812 At a Court began and held for Hardin County at the Court house in Elizabeth Town on Monday the 12th day of October 1812 Present Jacob ENLOW Adin COOMBES Augustine GREEN and Richard WALKER Esquires --------------- The last will and Testament of Henry DEAVER was fully proven by the oath of Thompson ASHBY to be the last will and Testament of said DEAVER ---------------- Ordered that John PAULY be and he is hereby appointed surveyor of the road leading from Elizabeth Town to the mouth of sinking which lies between the crossing of Otter Creek at John PAULYs and the Bee Knob and that the following hands towit Walter PAULY William PAULY James PAULY Stephen PAULY Samuel PEARMAN Joseph HAWK Drury HARDAWAY and his hands James MILLER John McDANIEL John MYERS do assist said PAULY in keeping said road in repair. --------------- Ordered that Adam MILLER be and he is hereby appointed surveyor of that part of the road leading from Elizabeth Town to FRAKERs Ferry which lies between Elizabeth Town and William HUMPHREYs and that all the hands that did assist said GRASS do assist said MILLER in keeping said road in repair. ----------------------- On the motion and Oath of Richard J. MUNFORD It appearing to the satisfaction of the Court that he is charged with two titheables for the two last years more than he had It is ordered that the sheriff give him a credit, therefore and that the Sheriff have a credit for the same in his settlements with the Court. ----------------------- Ordered that a summons issue to cause John TRUMAN to appear here at next Court to shew cause why a road should not be opened through his land. ------------------ Ordered that a summons issue to cause Robert THOMPKINS James LOGSDON James FRENCH and John THOMPSON to appear before the Justices of our next County Court to shew cause why they should not be fined & threble taxed for not giving in a list of their taxable property. ---------------- It appearing to the satisfaction of the Court that Bat STOVEAL is charged with one tithable and the said STOVEAL not being 21 years of age at the time his mane was taken in by the commissioners It is ordered that he be discharged from the payment of his county levy for the year 1811 collectable in 1812 and that the sheriff have credit for the same in his settlement with the auditor of public accounts County Court ------------------------ Ordered that James BROWN be and he is hereby appointed surveyor of the road leading from Hensely READs Hill to the Barrens in place of Philip READ and that all the Hands that assisted said READ do assist said BROWN in keeping said road in repair. -------------------------- Comwth vs John CALDWELL on summons for not giving in his list of property Ordered that this motion be and the same is hereby dismissed. ----------------------- Same vs Charles SAWYERS same Ordered that this motion be and the same is hereby dismissed. --------------- Charles SAWYERS senr is exempted from paying tax on two horses with which he was charged and the sheriff is to have credit for the same in his settlement with the auditor ----------------- Commonwealth vs Ezeriah SANDERS for not giving in his list of taxable property for the year 1812 Ordered that the Defendant be fined five Dollars ___ failing to give in his property and that he be threble taxed and pay the costs of this motion. ---------------- Commonwealth vs Robert SANDS for same Ordered that the Defendant be fined five dollars for not giving in his property and threable taxed and that he pay the costs of this motion ------------------ Commonwealth against Daviel LINDER for same For reasons appearing to Court, It is ordered that the said Daniel LINDER be and he is hereby fined the sum of five dollars for not giving in a list of his taxable property for the year 1812 and that he be treable taxed and that he pay the costs of this prosecution and may be taken ----------------- Commonwealth against Charles SAWYER Jun for same This day came the Defendant and he being heard and for reasons appearing to Court, It is ordered that the Defendant be fined the sum of five Dollars for failing to give in a list of taxable property and that he be treble taxed and that he pay the costs of this prosecution -------------- Ordered that John MYERS commissioner be allowed the sum of three Dollars out of the above fines -------------------------- Jacob ENLOW produced in Court a certificate of his being authorized to preach in the Methodist society a license is given him to solemnize the rites of Matrimony agreeable to law whereupon he took the oath required by law and entered into and acknowledged his bond with William WITHERS his security ------------------------------- The Court proceeded to lay the County levy towit Hardin County To Joel
