Court Order Book C July 13, 1812 pp 16 - 23 At a County Court began and held at the Court house in Elizabeth Town on Monday the 13th day of July 1812 ------------ Present Adin COOMBS Nicholas MILLER George HELM Lewis WELLS and Christopher Miller Esquires -------------- An inventory of the appraisement of the estate of Christopher DOUGHERTY was produced in Court and ordered to record. ------------- John SMOOT came into Court and entered into and acknowledged his bond as constable of Hardin County in the penalty of one thousand dollars with Lewis WELLS and John MILLER his securities conditioned as the law directs and took the several oaths prescribed by law. ---------------- Present Aaron HART Arthur McGAUGHY and William KEPINGER Esquires -------------- An Indenture of Apprenticeship between Benjamin HELM on the part of Thomas CHANEY a poor child and Samuel MARTIN was acknowledged by the parties and ordered to record. ------------- Present Samuel MARTIN and Benjamin SHACKLETT Esquires ---------------------- Joseph STITH produced in Court a commission from under the hand of his excellency Charles SCOTT Esquire Governor of Kentucky appointing him a Justice of the peace in and for the County of Hardin with the following certificate thereon endorsed (to wit) Hardin County Sct this day came Joseph STITH before me George HELM a Justice of the peace for the County aforesaid and took the oath of Fidelity and oath of office agreeable to the within commission Given under my hand this 4th day of March 1812 Geo HELM JPHC, whereupon he took his seat. ----------------- Present Richard WALKER Esquire ------------------ On the motion of Benjamin BRADSHAW It is ordered that George ROBERTS Joseph MOSBY James CAMPBELL William WOOD and John B. THOMPSON or any three of them do after being sworn before a magistrate of Hardin County examine state and settle with Benjamin BRADSHAW of his administration of the estate of John FORLILES ? deceased and that they do allot to Susanna TURNER late widow of the said decedant her thirds of the said estate also that they divide and allot to each of the heirs their distributive parts of said estate and that they make report thereof to court. --------------------- Ordered that Jacob VANMETER John RUSH Richard WITHERS and James ALLEN or any three of them do after being sworn before a magistrate of this County do view the nearest and best way for a road to lead from Elizabeth Town to the ohio river immediately below Jesse MOREMANs field & opposite the tobacco landing and that they report whose land the road leads through if known and whether the said road will be of public utility or not ----------------- Ordered that James HOUSE and Bethna WANNACK be summoned to appear here on the first day of our next August term and that they bring James HYAT before the Court and to Answer such other things as may be then and there pref_____ around them. ---------------- Ordered that Aaron HART and Samuel MAD__ superintend the next election to be held at the Court house in Elizabeth Town on the first Monday in August next and that John SNEED be and he is hereby appointed Clerk to said election ------------------- Ordered that Benjamin SHACKLETT and Joseph STITH superintend the next election to be held at Benjamin SHACKLETTs in the western precinct on the first Monday in August next and that Jacob ENLOW be appointed Clerk to said election ---------------- Ordered that Lewis WELLS and William KEPINGER do superintend the next election to be held at Arthur McGAUGHYs in the southern precinct on the first Monday in August next and that Dudley ROUNDTREE be appointed Clerk to said election. -------------- The last will of William WOOLEY Deceased was produced in Court and proven by the oath of Thomas MUNFORD a subscribing witness thereto and laid over for further proof. ------------- On motion of Adam SLATER and satisfactory proof being made to Court that he the said Adam SLATER in a fight had a piece bit out of the lower side of the left Ear which was ordered to be certified in the usual form. ---------------- On motion of Jesse DODSON who made oath that he stands charged on the commissioners book with two negroes to wit one above 16 years old & one under sixteen, more that he owned on the 10th day of March 1811 which tax is collectable in 1812. It is therefore ordered to be certified to the auditors of public accounts. Also the Sheriff is to have credit for the tithable on settlement with the county -------------- On motion of Anthony VERNON It is ordered that Robert C. SLAUGHTER Josiah ANDERSON & Barton ROBY be and they are hereby appointed to examine Slate and Settle with Anthony VERNON his accounts of his administration of the estate of Mary PEARPOINT Deceased and return their settlement so made to court -------------- On motion of Jeremiah PEARPOINT It is ordered that Jacob ENLOW George HELM or any two of them, are hereby appointed to examine state and settle with the said Jeremiah PEARPOINT his accounts of his executorship of the estate of Francis PEARPOINT deceased, and return their settlement so made to court. -------------- Ordered that Gabriel KIRKPATRICK be and he is hereby appointed Surveyor of the road leading from Joseph KIRKPATRICKs mill to the forks of Bacon Creek in place of William MORRISON and that all the hands that did assist Andrew LONG do assist the said Gabriel KIRKPATRICK in keeping said road in repair. ---------------- On motion of Moses THOMAS who holds a bond on Thomas HARGIS deceased as assignee of John BROWN for 300 acres of Land part of a settlement and preemption of JERROTS when the said Thomas HARGIS formerly lived bearing date the 7th day of October 1808. It is ordered that Anthony VERNON James EDLIN and George HELM be and they are hereby appointed commissioners to convey the said land agreeably to said bond to the said Moses THOMAS in pursuance of an act of the General assembly of Kentucky in such case made & provided. ------------- Commonwealth on Information for bastardy against Isaac MORRISON This day the Defendant appeared in discharge of his recognizance his counsel moved the Court to quash the Warrant recognizance and proceeding had thereon on the statute of Limitations which motion being argued by the counsel on both sides and duly considered by the Court It is the opinion of the Court that the motion be overruled. The Defendant on the trial of this cause filed the following bill of exceptions which were signed sealed and enrolled as a part of the record to wit, The Counsel for the Defendant in this cause moved the Court to quash said Information which is made a part of this exception on the statute of limitations which said motion was overruled by the Court and the Deft by his attornies excepts VIz and prays Geo HELM [seal] Lewis WELLS [seal] Samuel MARTIN [seal] Arthur McGAUGHY [seal] Joseph STITH [seal] Richard WALKER [seal] As the counsel for the Defendant moved to quash the said Information on an act of assembly ____ Dec 11th 1796 and the 46th section of said act 1st volume of Lettles, no other law being read to the Court the Court overruled the motion. ----------------- Benjamin OGDEN came into Court and resigned his office as Jailer of Hardin County. ------------- On motion of Sarah WISEHEART who took the oath prescribed by law the administration of the estate of George WISEHEART deceased is granted her whereupon she entered into and acknowledged her bond in the penalty of four hundred dollars with Andrew Fairleigh HARDIN Thomas Jeremiah PEARPOINT and John ECCLES her securities conditioned as the law directs ------------------- Ordered that Samuel MARTIN Frederick TULL James WILLIAMS and Thomas SWAN or any three of them do appraise the personal estate of George WISEHEART deceased after being sworn before a magistrate of this County and that they make report to court. -------------------- Taylor BAIRD came into Court and entered into and acknowledged his bond as constable of Hardin County in the penalty of one thousand dollars with Squire LARUE William CESNA ? and Samuel PERCEFELD his securities conditioned as the law directs and took the oaths prescribed by law. -------------- James W. HOUSEs Ear mark is as follows Swallow fork in the right Ear crop & half crop in the left Ear ordered to be recorded -------------- Frederick Tull came into Court and entered into and acknowledged his bond as Jailer of Hardin County in the penalty of one thousand dollars with Charles HELM and Samuel PERCEFULL his securities conditioned as the law direct and took the several oaths prescribed by law. ------------ Aaron TERRY came in to Court and entered and acknowledged his bond as Constable of Hardin County in the penalty of one thousand dollars with Aaron HART and Moses HART his securities conditioned as the law directs and took the oaths prescribed by law -------------- William WALKER came into Court and entered into and acknowledged his bond as constable of Hardin County in the penalty of one thousand Dollars with Richard WALKER John ECCLES and Jacob ASHCRAFT his securities conditioned as the law directs and took the several oaths of office. -------------- Isaac VERTREES came into Court and entered into and acknowledged his bond as constable of Hardin County in the penalty of one thousand dollars with Jacob VERTREES and Charles HELM his securities conditioned as the law directs and took the several oaths of office prescribed by law. ------------------ Commonwealth vs on Information of Bastardy Isaac MORRISON The Defendant moved the Court to quash the warrant herein for irregularities contained therein which was overruled by the court the Defendant filed the following bill of exceptions which were signed sealed and enrolled To wit Commonwealth vs Isaac MORRISON On Information The Deft by his counsel moved the Court to quash the afsd Information does not commence in the name of the Commonwealth nor conclude against the peace and dignity thereof which motion was overruled by the Court to said opinion the Deft excepts Viz and prays __ C.
