HALLY It is ordered that George HELM Charles HELM and Isaac ENLOW or any two of them be and they are hereby appointed commissioners to examine such witnesses as the said John H. HALLY or any persons concerned should think proper to produce in order to establish the Beginning and special calls of two entries and surveys one containing 200 acres in the name of Jeremiah MOORE and one in the name of William HALLEY containing 750 acres, both tracts lying near Elizabeth Town about 2 miles above HYNES preemption and that the clerk on application of said HALLEY or either of the persons concerned do Issue a warrant for that purpose. ---------------------------- The persons appointed to view the road leading from Elizabeth Town to the Rolling fork this day made the following report towit We the under named being first sworn before a Justice of the peace for Hardin County have viewed that part of the road leading from James FRENCHs to the mouth of Wilsons Creek to leave the old road at said James FRENCHES clearing and to intersect the old road again on the bank of the rolling fork opposite the mouth of Wilsons Creek we find the new road viewed by us to the driest and best ground and at least forty poles the nearest. The above road is contemplated to go through James FRENCHes John KINNEYs and Joseph FRENCHes land given under our hands this 9th day in Sept 1812 Mark BREWER, John SHERROD, James FRENCH Whereupon It is ordered by the Court that a summons issue to cause the said James FRENCH John KINNEY and Joseph FRENCH to appear here on the first day of our next April Term to shew cause why said road should not be opened through their land. ---------------- Ordered that it be certified to the auditor of public accounts that Christopher BUSH be allowed the sum of nine shillings for guarding negro CON who was charged with felony three days from the Jail in the County and back again to Jail being summoned by the Jailer under the direction of the Court ---------------- On the motion of Daniel WAIDE license is granted him to keep Tavern in his house in Elizabeth Town for twelve months from this day whereupon he entered into and acknowledged his bond with Benjamin HELM his Security conditioned as the law directs. ------------------- On motion of Samuel STEVENSON license is granted him to keep a Tavern in his house in Elizabeth Town for twelve months from this day whereupon he entered into and acknowledged his bond with John MILLER his Security conditioned as the law directs ------------------ Jasper TERRY appellant on appeal from a Judgment against of Lewis WELLS esq John KEYS appelee This cause being argued by the counsel on both sides and duly considered by the Court It is the opinion of the Court that the magistrates Judgment be and the same is hereby confirmed and that the appelee recover against the appellant the sum of fifteen dollars twenty eight cents and five mills with Interest thereon from the 2nd day of July 1812 until paid and 25 cents costs expended before the magistrate also his costs expended by him about his defence herein ---------------------- Same vs Same Charles MEREDETH claims two days attendance for the appellant --------------------- Samuel PERCIFULL late Deputy sheriff of this County this day produced in Court a delinquent list of the county levy for the year 1811 collectable in 1812 which was received by the Court. ------------------- Ordered that George NEWMAN be and he is hereby appointed Surveyer of that part of the road leading from Elizabeth Town to salt river which lies between Nicholas HOBS and where BRANDENBURGs road intersects the same and that Carter BAILY William HOLTSON Michael MELTON John MELTON Abejah ALLEN William ALLEN Joseph SCOTT William GLASS James THOMPSON Isaac THOMPSON William SUMMERS William ALLEN John _ GIBBS and Jonas GRAY do assist said NEWMAN in keeping said road in repair ------------------ Ordered that a summons issue to cause Jesse FRIEND John RAY and old Wm HUTTON to appear before the Justices of our next County Court to shew cause why their children should not be bound out ------------------- On motion of Michael HARGAN a Ferry is established on his land across the Rolling fork and it is ordered that he be allowed one hand as a ferryman to transport persons horses &c across said river and that he receive the sum of twelve and a half cents for transporting a man and horse whereupon the said HARGAN entered into bond with George HELM his security in the penalty of twenty pounds conditioned as the law directs -- The said Ferry is established across the rolling fork where Middleton now lives. ---------------------- Samuel PERCEFULL Deputy sheriff for William WITHERS late sheriff of this County returned in Court a delinquent list of the revenue tax for the year 1811 collectable in 1812 which was received by the Court and ordered to be certified to the auditor of public accounts. Also a Delinquent list of the revenue tax returned from the Auditor of public accounts which was also ordered to be certified to the auditor of public accounts ------------------------ Ordered that Court be adjourned till Court in Course C.
