In the first place I do will and bequeath my Soul to God for mercies that he has Shown towards me. Secondly after my death I woul wish to be decently buried in Some convient burying place and after all Expenses are paid for the Same I do thirdly will and bequeath unto my Sons, Jacob John & Philip Earhart one dollar Each to be paid them after my death within one year. To my daughters Elizabeth Mary Lydia & Rachel I do will and bequeath one dollar Each to be paid in Like manner of my Sons and to the heirs of my daughter Nancy now deceased. I do will and bequeath the Sum of one dollar to be paid as my other Sons and daughters. Fourthly I do will and bequeath to Elizabeth Frederick the daughter of my daughter Susannah Frederick deceased all of my property that is left after burying expenses and all adets and above mentioned children of mine are paid the amount of my estate both real and personal. I do wish my Executors to hold under their controle the above property for Elizabeth Frederick untill She arrives to the age of Eighteen and excepting So much as they may deem necessary to appropriate towards Schooling and clothes. I do likewise will and request that in case Elizabeth Frederick. Interlined before signed, Should die without heirs that her legacy may go to the benefit of my own daughters or their heirs. Placing great confidence in John Arnold and James Castleman Segn of Hardin County State of Kentucky I do hereby appoint and nominate them for my Executors to See that my last will is justly and Truly distributed fulfiled. for their Labour and Trouble I likewise wish for them to be paid (transcriber unable to see amount) Sealed and delivered in the year of our Lord one thousand Eight hundred and Twenty one her Test James S Singleton Mary X Earheart William Wadley mark At a court began and held for Hardin county at the court house in Elizabeth Town on Monday the 7th day of August 1826 The within Instrument of writing purporting to be the last will and Testament of Mary Earheart deceased was produced in court and proven by the oaths of James S Singleton and William William Wadley to be the last will and Testament of the Said Mary Earheart and that She Signed Sealed Published and Pronounced the same as Such in their presence and that they Subsevilled the Same as witnesses thereto in her presence & in the presence of Each other and that they believed the Said Mary Earheart to have been in her perfect mind & memory at the time of Publishing the Same & thereupon the Same was one rcord to record by the Same is accordingly none Additional Comments: Transcription by Sherrie Kahle Childers.
