Will Book B p. 89 In the name of God Amen, I PETER MILLER do make and adopt this my last will & testament being weak of Body but of sound memory do leave my Real and pesonal Estate in the manner following Viz: First I leave to my loving wife SARAH the plantation where I now live on as along as she Remains a Widow and at the Death in case she does not marry then all the Lands I possess is to be sold and the money arising therefore to be divided Equally amongst my Children that is to say my son JOHN MILLER and my daughter NANCY MILLER now NANCY DUNCAN, ELIZABETH MILLER now ELIZABETH TAYBERT (?) and PETER MILLER these my children is on by to Receive one half of a childs part arising from the Sale of the lands but the above named children is to receive no part whatsoever of the personal estate and further if my wife SARAH marries then the Plantation is to be Rented out and the profits arising ther from to be Equaly divided amongst my Daughter POLLEY and my sons ROBERT JAMES SAMUEL and HIRAM after my wife Getting her thirds the said Proffits or monies arising from s’d farm not to be paid yearly nor in till he comes of age and if my wife Does not marry then she is to have her Choise of five cows & calves for the support of her & family and all the proffits Arising from them as long as she lives. Also I leave my Sloving Horse and Sloving Black mare a Rone Horse Bay mare and my --- Mare is to be left for the Support of the Plantation & to my wife as long as She lives and Remains Single. Also I leave to my daughter POLLEY young Black 3 year old mare with a mark on her face this I leave to her over and above a child’s part. Also I leave to my son ROBERT a young colt, the colt of KET (?) TAYBERT’S (?) her over and above a child’s part and as for my stock of Hogs they are to Remain on the plantation for the Support of my family as long as my wife Remains Single and if she marries then the Hogs is to be sold and divided Equally amongst my children after Receiving her thirds and further my stack of Cattle after taking five cows and calves for the use of the family the remains six cows five grown steers and number of young cattle to the amount of thirty four all that is to be sold for the Benefit of my children. Further there is seven head of horses also to be sold for the Benefit of my heirs it is Further to be distinctly understood that the above named JOHN MILLER, NANCY DUNCAN, ELIZABETH TAYBERT and PETER MILLER my sons & daughters to have no part of any of the proffits arising from the sales of my horses & cattle which proffits is to be equally divided amongst my Daughter POLLEY and my sons ROBERT, JAMES, SAMUEL & HIRAM after my Wife Receiving her third and the above named JOHN NANCY ELIZABETH and PETER is only to Receive the half of a child’s part of the land that is to say suppose the lands to sell for nine hundred Dollars then the above named JOHN NANCY ELIZABETH and PETER are to Receive fifty Dollars a piece as their part and the Rest of the heirs towit, POLLY ROBERT JAMES SAMUEL and HIRAM to Receive one hundred Dollars a peace (?) as their par first deducting out of my wifes thirds and in like proportion as the Lands sells higher or lower and in case my wife Marries all my house hold fourniture of Every description with all my farming utencels is to be sold for the Benefit of my heirs and all the moneys and proffits arising there from. I wish my Exacter or Exacters to put out at Interest untill my son HIRAM comes of age and then to pay my heirs as above mentioned their Respective dues. In witness whereof I have set my hand and seal this 16 May 1813. MILLER and DENTON GOGHEGAN my sole Exacters to this my last will and Testament. Wits: DENTON GEOGHEGAN ACHILLES MOREMAN JAS. MILLER Recorded 11 Oct 1813 Hardin Co. KY Court Whereas I PETER MILLER of Hardin County have made and duly Executed my last will and Testament bearing date some time in June last and which is now in the possession of JAMES MILLER one of my Executors named in said Will and as the said MILLER lives at a distance as my weakly situation will not admit of delay have been compelled to omit the presise date of said Will in this codicil but the more plainly to designate said will I do hereby declare it is to be witnessed by JAMES MILLER DENTON GOGHEGAN and ACHILLES MOREMAN which said last will and testament and every clause bequest and devise therein contained I do hereby Ratify and confirm (saving such excepting such clauses bequests and devises there in mentioned as are by me herein after Revoked and made Void) and being desirous to alter som parts thereof and of making additions, do therefore hereby make this my codicil which I will & direct shall be taken and held as part of my said Will and Testament in manner and form following that is to say all my personal Estate is to be sold agreeable to said Will and of my children that is of age is to Receive his or shear arising from said sale agreeable to said Will Reserving to those that are not of age their Respective Shares agreeable to said Will the shares arising to each of my Children now of age shall be paid to them Respectively so now as the money arising from said sale shall be collected and whereas I did constitute and appoint JAMES MILLER one of my executors to my said Will now I do by this codicil will and desire that the said JAMES MILLER shall not be one of my Executors of my said will and do hereby Revoke my appointement of him as Such and in his Roome shall constitute and appoint my friend JACOB VAN MATRE one of my Executors of my said Will as fully and effectually as if he had been originally in and by my said Will constituted and appointed Executor thereof in Testimony whereof I have here unto set my hand and affixed my seal this 11 July 1813 (Signed) PETER (X) MILLER In the presence of JAMES WILLSON, JOHN AMENT and JACOB VANMATRE.
