Simpson: In the Name of God Amen. I John Pennel of Hardin County and State of Kentucky, being sick and weak of body but of perfect mind and memory thanks be to almighty God, do make this my last will and testament as followeth, that is to say, I recommend my soul to God who gave it and my body to be Buried in a Decent manner in the discretion of my surviving friends - And as to my worldly estate both real and personal in the first place will that all my debts be paid out of my personal estate, secondly that the whole of the remainder both real and personal be and continue under the care and management of my beloved wife Amelia / so much for the purpose of maintaining the family so long as she remains my widow and in as much as I have three daughters married all of whom have already received small bequests, I will that each and every of the others receive the same or the value thereof. I also will that the balance both real and personal after wifes decease be equally divided among all my children. In witness whereof the said John Pennel hath hereunto set his hand and seal this 21st day of August 1828 signed in the presence of Wm. Scott John Pennel(Original signature and hand drawn seal) Geo. Paul At a court began and held for Hardin County at the court house in Elizabeth Town on Monday the 6th day of October 1828 the foregoing instrument of writing purporting to be the last will and testament of John Pennel deceased was/produced in court and proven by the oaths of William Scott and George S. Paul the two subscribing witnesses thereto to be the true last will and testament of said John Pennel declared that the said John Pennel signed Sealed Acknowledged and the same as such in their/presence. That they believed him to be in his perfect mind and memory at the time of doing the same, and other respects as the law directs & the same was ordered to be recorded And thereupon the same is truly recorded in my Office this 21st day of October 1828. Sam Haycraft Clk. Transcriber's note: Some researchers mistakenly believe that John Pennell married Attaway Wilson in 1819. This was a different John, who could very possibly have been a son of the John Pennell whose will appears above. Given the text of this recorded will, it is clear that Amelia Hunter remained his wife until she was widowed.
