The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net **************************************************************** WILL OF THOMAS ROBINSON OF THE COUNTY OF HARDIN AND STATE OF KENTUCKY I Thomas ROBINSON of the County of Hardin and State of Kentucky, being sound in mind, but knowing the uncertainty of human life, in order to make such distribution of my estate as it consonant with my wishes, make and publish this as my true last Will and Testament. Item 1st, It is my will and Desire that all my just debts that may be owing at my death, shall be paid out of my estate by my wife, Lucy P. (sic) (S) ROBINSON, in the manner she may think best calculated to effect that end to the Interest of herself and the other devisees hereinafter named. I give and bequeath to my Wife, Lucy P (sic) (S) ROBINSON, the farm whereon I now lie, together with all the improvements thereon. Also, all my negroes, my personal property of every description, during her natural life to enjoy, together without sale for the use of herself and such of my single children as may remain with her. And at her death, it is my will and desire that the same with the exception of the home plantation before given her, which I hereby will and bequeath to my son, Thomas ROBINSON, at her death shall be equally divided amongst my children; Catherine ROBINSON, Susan ROBINSON, Jesse M ROBINSON, Lucy ROBINSON, Martha ROBINSON, Thomas ROBINSON, and Rosina ROBINSON. *(this may be Item 2nd, which was left out in the first transcription) And it is, further, my wish and desire that my said wife, Lucy L ROBINSON, shall in the event of the marriage of any of the above named children before her death, give to them such part of my estate as she can spare. At the time being charging said child or children, therewith so as to make equal distribution in the ends. Item 3rd, I give and bequeath to my son, Jesse ROBINSON, all that part of my land contained within the following boundary, to wit. Beginning at the north East corner of the school house lot running thence westwardly to the divises line between John STITH, Sr, and myself, thence North wardly to James G CLARKSON's line, thence eastwardly to the land between said Clarkson and myself, thence westwardly southwardly to the (?) road, thence down the same westwardly to the corner of meeting house lot, thence with the eastern line thereof, to the Northeast corner thence westwardly with said line and the line of Oty G WRIGHT, lot to the school house lot, thence Northwardly to the beginning to him and his heirs forever. Item 4th, I give & bequeath to my son, Jesse M ROBINSON, & Thomas ROBINSON, the land I purchased of James A SOUTHARD, when the same is paid for. Item 5th, I give and bequeath to my daughters Catherine, Susan, Lucy, & Martha & Rosina ROBINSON, all the unsold land I won south of the Big Spring to be equally divided amongst them. Item 6th, Having heretofore given to my married daughters, to wit; Elizabeth RAWLINGS, Jane SWEET, Mary SWEET and Judith Ann GRAY, as much of my estate (as after the payment of my debts will remain) for my other children. I therefore give them no further part of my estate. Lastly, I hereby appoint my wife, Lucy S ROBINSON, Executrix of this my will. ROBINSON (seal) B H CRUTCHER Walter I STOUT ================ Thomas ROBINSON hereby add this codicil to this my last will and testament, to wit: I give the present citizens of the Big Spring and all others that may hereafter reside there, the (is)sue of the water from the head of the said Big Spring, to the place where the same sinks for there use forever. And no one is to encroach thereon to the exclusion of others, but every one is to have the free use of the water. As witness my hand and seal this 27th day of December, 1839. Test, Thos. ROBINSON (Seal) B CRUTCHER William WISEHART Walter I STOUT =============== At a county court began and held for Hardin County at the courthouse in Elizabethtown on Monday the 20th day of January, 1840, an instrument of writing purporting to be the last will and testament of Thomas ROBINSON, dec'd was produced in court and proven in due form of law by the oaths of Burr H CRUTCHER and William M SCHEVET two of the subscribing witnesses thereto who deposed upon oath that the said Thomas ROBINSON hath signed sealed and published the said writing as & for his last Will and Testament in their presence and that they believed he was in his perfect mind and memory at the time of doing the same and that they have at his request attested the same as witnesses in his presence and in the presence of each other. Whereupon it is ordered that the said Instrument of writing be established as the true last will and testament of the aid Thomas ROBINSON, deceased, and as such to be recorded. Whereupon the same is accordingly done this 24th day of January, 1840. Saml. HAYCRAFT, Clk
