Harlan County, Ky - January 1831 Court Orders Submitted by Kathy Welder Court Orders JAN. Session, 1831 Preceding Justices: Luke NOE, Wm. FARMER, Sam'l HOWARD A claim filed by John LEWIS for $9.50 at the Nov. 1830 term, to be listed by the clerk. James FARMER appellent vs. Thomas SEWALL, a continuance. Carr BAILEY be appointed overseer of the road, James SHORT removed. Luke NOE, John JONES SR. and Ben POSEY last appointed to view and mark out a road from the lower end of Moses's BALL's big field, opposite his old dwelling, down Catron's creek, & to intersect with the county road. All report they have viewed and marked and said road will pass thru the land of BALL and that of General George BRITTIAN. FEB. Session present are: Elijah GREEN, Luke NOE, Joseph BENJAY, Samuel HOWARD, John CREECH, Hiram JONES, John HENDRICKSON, Wm. FARMER, Mount PERCIFUL and John NOE, Esq. The Court to order that Samuel HOWARD Jr. age 9 years got his left ear bit off by a horse. Charles BLAIR exempted from county levy. John McGEORGE appointed a Constable of this county & entered into a $2,000. bond with Samuel HOWARD & Elisha GREEN as his securities. Oath administered. Elisha GREEN Esq.& Wm. FARMER authorized to solemnize the rites of matrimony. Wm. TURNER Jr. appointed a Constable in the room of James TURNER, who resigns. A $2,000. bond with Samuel MARK & Thomas SEWALL his securities, Oath administered. Ordered a Summons be issued for James BARNETT, John WILEFORD, Jacob SLUSHER, & the heirs of John HOWARD, deceased. Gabriel JACKSON, Benja. HOWARD, Phillip HOWARD, Andrew LEE and Phillip SLUSHER to appear on the first day next term court, to show why a road should not be built thru their lands. On the motion of John CREECH, it is ordered that John DIXON, Wm. CREECH, Hiram LEWIS, Bennett BALL & Wm. SMITH are appointed to view and mark a road from John CREECH's to Bennett BALL's meeting house and report next session. Mount PERCIFUL appointed overseer in the room of James SPICER, & he together with the same hands [men] in the same boundary with John BAUGHMAN to keep in repair. Lewis GREEN and others summoned to show cause why a road shall not be opened over their land, and appearing not, it is ordered that the road from Wm. GREEN's to Cumberland Gap be established and Robert GREEN be appointed overseer from the start to Levi HOSKINS, then HOSKINS to a white oak branded SW, from there Joseph BAKER to oversee to his house, then Christain HENDERSON to the state road near Cumberland, these above to cut and maintain the same road. Ordered that a Summons be issued to Nancy HALL to show cause why her child shall not be bound out. MARCH Session: present; J. NOE, Nathan HARRIS, H. BRANSON, H. JONES and John CREECH. Wm. BINGHAM vs. Gabriel JACKSON, motion continued generally. Admin.. of G. BALEY, deceased, made their report & ordered recorded. Letters of Administration granted to Mount PERCIFULL for the Estate of Peter PURCIFULL, dec'd; $400. bond with Elijah GREEN, as security. William GREEN and William SPARKS appointed to appraise the estate. Randolph NOE & Stephen RICE appointed commissioners to take in the lists of taxable property. Wm. SMITH appointed Constable, bond $2,000. James FARMER vs. Thomas SEWALL, appeal, Judgement cost confirmed. The Attorney for the county court, it is ordered that a Summons be issued for John F. HOWARD and his securities, to show cause, if any, why execution should not issue on his bond to the court; on the bastardly case for the benefit of Nancy HALL, to appear at next court. Those appointed to view and mark the road from John CREECH's to Bennett BALL's report; "We did on the 26th of Feb. meet at John Creech's where it was proposed that said road shall begin it's 2 1/2 miles from the North side of Poor Fork, a hundred yards above Creech's river crossing, thence up a branch called the Clover Gap, thence up the fork ridge thru the Gap to Bennett Ball's...`the road across the mountain from Poor Fork to Clover Fork will save the citizens 20 miles travel. The road will run thru lands of John CREECH, Abner FIELD & Bennett BALL." John CREECH is appointed overseer and to have the hands from William COLDIRON's, to Samuel POWELL's on the Poor Fork and from Nimrod BALEYS to James TURNER on Clover Fork, to cut out & keep in repair. Jacob WOOLUMN appointed overseer of the road from John HENDERICKSONS barn at the cane bottom field to Clay County line, with the hands living within said bounds along with John C. MILLER, to maintain said road to the Knox County line. On the motion of John SPARKS, he & John JULIAN, William & George SPURLOCK, and Jesse BULL are appointed to view the nearest and best way from the county road near John KEYWOOD's, up Martin's Fork to William SHORT's Mill and report findings at next court. Nathan HARRIS, Esq. authorized to solemnize rites of matrimony; $500. bond with Wm. LEWIS as security.
