Howard a Justice of the Peace within the county and state aforesaid Edmond Gross aged sixty years a resident of Harlan County and state of Kentucky being duly sworn according to law declares that he is the identical Edmond Gross who was a Private in the Company Commanded by Captain Samuel Callen in the fifty fourth Regiment of Virginia Artillery Commanded by Col. Read in the war with Great Britain. that he volunteered at or in Pittsylvania County Virginia on or about the first of April one thousand eight hundred and fourteen for the term of six months and continued in a___ service in said war for the term of sex months and was honorably discharged at or on Cray Island in Virginia on the, or about the first day of December one thousand eight hundred and fourteen, as will appear by the muster rolls of said court any certificate of discharge being lost. He makes this declaration for the purpose of obtaining the bounty land to which he may be entitled under the "act granting bounty land to certain officers and soldiers who have been engaged in the military service of the "United States" passed September 28th 1850 Edmund Gross Sworn to and Sbuscribed before me the day and year above written. And I hereby certify that I believe the said Edmond Gross to be the identical man who seved at aforesaid and that he is of the age above stated. I do further certify that I am not interested in this in any matter what ever Jas B Howard J. P. 2nd Declaration State of Kentucky, county of Harlan On this 9th day of march AD one thousand eight hundred and fifty seven Personally appeared befroe me a justice of the peace, within and for the County and state aforesaid, Edmund Gross, aged 64 years, a resident of Harlan County, in the State of Kentucky, who being duley sworn according to law, declares, that he is the identical Edmund Gross who was, a provate in the Compnay, Commanded by Captain Saml. Callen in the 54 Regiment of Virginia Militia commanded by Lieutent Col. Reed in the War with Great Britain, declared by the United States, on the 18th day of June 1812, that he enlisted at Pittsylban C.H. on or about, the first day of April AD 1814 for the term of six months and coninuted in actual service in said war, for the term of six months and was honorably discharged at Crany Island on the 14 day of October AD 1814 He makes this declaration for the purpose of obtaining the bounty land, to which he may be entitled under the act approved, March 3rd 1855. He also declares that he has not, received a warrant for Bourntyland, under this or any other act of congress, Edmund X Gross We Wm Gross and Lewis D Green residents of Harlan county in the State of Kentucky, upon our oaths declare, that the foregoing declartion was signed, and acknowledged by Edmund Gross in our presence, and that we believe, from the appearance and statements of the applicant, that he is the identical person he represents himself to be. the said Wm Gross states that the service sett forth in the Declartio is true to his own personal knowledge William Gross L D Green Additional Evidence The com from the Pension Office. Dated Aug 17 1859 in regard to the claim of Edmund Gross, for the Bounty Land under the act of March 3 1855. was received and contents noted. The Coms of Pension seems to infer from the form of the accompnay certificate that he has formerly received one of his Land warrants, But such is not the case, as appears from his declaration which is filed in the pension office - He has never received any Land Warrant whatever, as the following certificate will prove. State of Kentucky, county of Harlan On this the 25th of October 1859. One thousand eight hundred and fifty-nine, personally appear before me David Baily a Justice of the Peace for said County and State of Kentucky Edmund Gross who being duly sworn according to law, declare that he has not applied for any bounty Land except the application referred to by the Coms of Pensions dated Aug 17 1859 and an application Made by his attorney W. W. Watkins five or six years ago, but that he has never received any land warrant under this or any warrant for Bounty Land. Given under his hand Oct 25th 1859. Edmund X Gross State of Kentucky, Harlan County sct Harlan C House KY, Aug 10th 1860, Affidavit This day Edmund Gross personally appeared before me the undersigned a Justice of the Peace in an for Harlan County, Ky, duly empowered to administer oaths and made othat that, the explanation by the Coms of Pensions in his letter of Janry 11th 1860, to with: "an explanation under oath in required on account of a disimilarity of the signature" He states that for some time he has been greatly afflicted with Palsy, rendering him unable to to write at all. This he states on oath is the reason of why his signatures are disimilar. When he made his mark, he was in a condition he could not sign his name, and is at this time in a condition that he is compelled to make his mark, as will appear below. Witness Aug 10th 1860 We Adrian Nolin and Jonathan Bailey residents of Harlan County in the State of Kentucky, upon our oaths declare that the foregoing declaration was signed by making his mark, by Edmund Gross, and acknowledged in our presence by him, and that we beliee from the appearance of statements of the applicant, that he is the identical person he represent himself to be Jonathan Bailey, Adrian Nolen State of Kentucky, County of Perry On ths 30 day of July AD 1869 personally appeared before me a notary public within and for the County and State aforesaid Edmond Gross aged 77 years, a resident of Harlan County in the State of Kentucky who being duly sworn according to law, declares that he is the identical Edmund Gross who was a private in the Compnay commanded by Captain Sam Collin in the number (not recollected) Regiment of Virginia Vols Inft commanded by Colonel (name not remembered) in the War of 1812 & C remembers his name of the Major Lindsy enlisted for 6 months and served the term out, and continued in actual service in said War for the term of fourteen days; that he has heretofore made application for bounty land under the act approved and obtained a land warrant for 60 acres No- He makes this declaration for the purpose of obtaining the additional bounty land to which he may be entitled under the act approved March 3 1855. He also declares that he has not received or applied for bounty land under this or any other act of Congress except the one above mentioned. I hereby authorize and empowere Fitch & Fee of Washington D.C. my attoneys, to prosecute this my claim, to receive any certificate or warrant which may be issued to in my name, receipt for the same and receive any and all moneys due thereon, giving unto them full power to endorse my name on said certificate or warrant and to do any other act in my name necessary to the full and final settlement of the cliam Edmond X Gross Isaac Baker Isaac Baker resident of Perry County in the State of Kentucky upon our oath, declare that the forgoing declaration was signed and acknowledged by Edmond Gross in our presence, and that we believe from the appearance and statements of the applicant that he is the identical person he represents himself to be; and that we are not interested in the claim, John M. David Isaac Baker War of 1812, Declaration of Soldier for Pension Stte of Kentucky, County of Harlan On this twenty seventh day of July AD one thousand eight hundred and seventy two personally appeared before me J K Bailey Clerk of the Harlan Circuit Court a Court of Record within and for the county and State aforesaid, Edmond Gross aged Seventy nine years, a resident of Harlan, County of Harlan State of Kentucky, who being Duly sworn according to law, declares that he is married; that his wife's name was Hetty Brock to whom he was married at in Harlan on the (blank) day of (blank), 1817; that he served the full period of sixty days in the service of the United States in the war of 1812;that he is the identical Edmond Gross who Enlisted in Captain Samuel Collens company 1812 (blank) 1812, and was honorably discharged at Cranie Island (blank); that he was in a battle on Cranie Island in Col Lindsys Regt. That he served and Discharged. That hs discharge was sent with application for Land warrant. That he drew a land warrant under act of Congress granting land warrant to soldiers of the war of 1812. R.W. Walker of Washington DC his true and lawful attorney ...........;that his post office is at Harlan CH County of Harlan State of Kentucky; that his docicile or place of abode is Harlan County Edmond X Gross applicant Attest: James Nappier Solomon Burkhart War of 1812 Widow's Pension Claim State of Kentuckyk, County of Harlan On this 15th day of August AD one thousand eight hundred and seventy nine personally appeared before me, Clerk of the Circuit Court, the same being a Court of Record of Harlan County, in the State of Kentucky, who being duly sworn according to law, declares that she is a widow of Edmond Gross deceased, who was the identical Edmond Gross who served under the name of Edmond Gross as a private in the compnay commanded by Captain Collin in the regiment of (blank), commanded by Col Reed in the war of 1812; that her said husband volunteered at Virginia on or about the (blank), and whose services terminated, by reason of Expiration at (blank). She further states that the following is a full description of her said husband at the time of his enlistment, viz: about 18 years old a Farmer born in Virginia 5 ft 8 inches high Black hair Black eyes dark complexion. she further states that she was married to the said Edmond Gross, at the city of Mt Pleasant, in the county of Harlan, and in the State of Kentucky 1816, by one George Brittain, who was a Justice of the peace and that her name before her marriage was Hetty Brock, and that she has not remarried since the death of the said soldier; and she further states that her nor her husband had ever been previously married and that her said husband Edmond Gross, died at Harlan Co., in the State of Kentucky, on the 7th day of April, AD 1871; and she further declares that the following have been the palces of residence of herself and her husband since the date of his discharge from the Army, viz: have lived always since marriage in Harlan County Kentucky.........she has heretofore made no application for pension, that her husband obtained a pension and died a few days after his pension certificate was granted (blank) county of Harlan, State of Kentucky, and her post office address is Harlan Court House Harlan County Kentucky Hetty X Gross Attest: John W. Forester James B. Howard Also personally appeared John W. Forester, aged 41 years, residing at (blank) and James B.
