It is my Will and desire that all my just debts shall be paid & all debts due to me to be collected by my executors. It is my will and desire that my loveing wife Mary Hutcherson shall have possession of all my estate both real & personal during her Widowhood or natural life for the purpose of supporting herself & such of my children as will live with her (except such exceptions as I shall hereafter make. I give & bequeath to my son Charles Hutcherson a bay filly with a blaze face two years old, & a cow some time here after (which suits or is convenient for him to receive her & the executors to give her) to make him equal with my other sons at present. I give and bequeath to my Daughter Pheabe Hutcherson a good bed & furniture & a cow to be give her when she shall call for them, which will be equal to what I give my other daughters when they left me also a good ewe. It is my will and desire that James White shall live where he now lives without paying any rent until a final divison shall take place because he has a parcel of motherless children. It is my Will and desire that my son John Hutcherson shall live where he now lives without paying any rent until a final division takes place because he made the said improvements. It is my Will and desire that there shall be as much land laid off By my executors as they think sufficient around my Dwelling house for to be Occupied by my wife Mary with the said house to support her stock & family during her natural life or Widowhood and the ballance of my cleared land to be rented out by my Executors while my sd wife remains a widow or dureing her natural life for the benefit of all my children at the final division which is to take place at the termination of my said wifes widowhood or natural life. I also request my executors to sell (all my horses but three for the use of my wife) (and to be her choice) & half my cattle & half my sheep and the money arising therefrom to be applyed toward my just Debts & if deficient the Ballance to be paid out of the rents. And when my wife Mary shall be no longer a widow or shall have departed this life It is my will that all my estate then remaining Both real & personal shall be equally divided among all my children who are now alive & my Grand Children who are the issue of my daughter Frances and James White & my Grand Child the issue of my daughter Sally & John Marsh & my Grand Children the issue of Edward Hutcherson now deceased & Also I give & bequeath to my daughter Jenny Kensler one good ewe she having received no sheep from me before. Also I allow & request my said executors to sell at .........? the surplus of corn oats & other perishable property not needed by my said Wife (as is customary on such occasions) & now remains on hand. I hereby nominate Constitute & apppoint Edward Coleman & William Moore Executors of this my last will & Testament & in case they my said Executors shall think fit they shall chuse a third person to aid them in the Execution of their Executorship Given under my hand & seal this 31st day of May 1805 John Hutcherson Senr L.S. Coleman Daniel Broadwell Harrison County August Court 1805 Sct The Last Will and Testament of John Hutcherson decd was proved in Court by the oath of Henry Coleman Benjamin Coleman & Samuel Broadwell Subscribing Witnesses There to and Ordered to be recorded, Att W. Moore C.H.C. Harrison County, Kentucky Will Book A, Pages 76 & 77 In the name of God Amen The Eleventh day of February 1807 I Mary Hucherson of the County of Harrison and State of Kentucky being very sick and Weak in body but of perfect mind and memory Thanks be given unto God therefore calling unto mind the Mortality of my Body and Knowing that it is appointed for all Men once to die do make & ordain this my last Will & testament That is to Say principally & first of all I Give & recommend My Soul into the hand of Mighty God that Gave it & my body I recommend to the Earth to be buried in decent Christian Burial at the Descreetion of my Executors Nothing doubting but at the General Resurection I shall receive the Same again by the Mighty power of God and as touching such Worldly Estate where with it has pleased God to bless me in this life I give ........ & dispose of the same in the following manner & form First I give to my daughter Mary Lewis Crosswhite three slaves viz, Frederick Charlotte & Creener Secondly I give to my daughter Jane Stears Kinsler three slaves (viz) Levi Lucinda & her child I also wish for Lewis to be appraised and for my Daughter Mary to keep him & pay my Daughter Jane the one half of his appraisement & my Desire further is that all other things that I die possessed of be equally divided between my aforesaid two Daughters Except Margaret who for her faith full Services unto me I desire may go free to herself. Lastly I constitute make & ordain my beloved Friends Jacob Powers & Robert McKitrick Executors of this my last will & testament - Revoking and utterly disallowing all other former wills - Legacies & Executors by me & in any ways before named - Ratifying & Confirmilng this & no other to be my last will & testament In Witness Where of I have hereunto set my hand & Seal this day & year first above Written Signed, Sealed & c, In presence of her markMary x Hutcherson L.S.
