JAMES POLSTON, Penson Application, residing in Hart County, KY Submitted by Garland Kenneth Childress and Edith Bastin U.S. PENSION AGENCY LOUISVILLE, KY April 19,1897 I hereby report that the name of JAMES POLSTON, Pvt. Co. B, 33 Ky. Vol. Inf. and Co. H, 26, Ky. Vol. Inf., who was pensioned on the rolls of this Agency, under Certificate No. 701322, and who was last paid at $12, to August 4, 1896 has been dropped because of death, August 10,1896. AFFIDAVIT OF JAMES POLSTON JULY 7, 1869 James POLSTON, aged 31 says he was stricken with paralysis on or about the 15th day of June 1865. He has lost the use of his left arm and leg. Andrew POLSTON attests to the above with his mark . In 1894 William WOOWARD presents affidavit affirming James POLSTON took sick at Salisbury, NC about June 1865 and was attacked by vomiting, high fever and chronic diarrhea. On July 12, 1890, James lists his age at 54 and in addition to his other affliction, he is loosing his sight. This also contains a deposition of Elizabeth POLSTON, sister-in-law of the applicant. DEPOSITION OF ANDREW POLSTON On June 23, 1881, Andrew POLSTON, late of Co. H, 26, Ky. Vol. Inf., P.O. Forrestville, Ky. says that on or about June 10, 1865 at Salisbury, NC, he found James POLSTON sick in camp and he remained sick all the time the Company traveled to Louisville, at which place they carried him to a citizen Doctor. Upon his arrival at Bacon Creek Station, in Hart County, "We carried him on horseback 2 1/2 miles to his home." GENERAL AFFIDAVIT State of Kentucky County of Hart In the matter of claim of James Polston 145.716 Personally came before me, a Deputy Clerk in and for aforesaid County and State, Elizabeth Polston a person of lawful age, who being duly sworn, declare in relation to the aforesaid case as follows: That my present age is 52 years. I reside in Hart County Kentucky. My post office is Kessinger. I have lived a neighbor to James Polson since his discharge. I saw him the day after he came home from the Army. I sat up with him and waited on him for about two months during his sickness his physician, was Dr. Cleaver and I saw him treat claimant many times during sickness and caimant was reduced in flesh until left hip and left elbow cut through. This was in July and August 1865 and for the remaind of year 1865 was not able to perform any labor. I am Sister at Law of claimant but have no interest in caim. Inft of the war of 1861; that at the time of his enlistment, said James Polston was in appeareantley good health and free from paralisisis of left side arm and leg and while in the military service of the United States, in the line of his duty, and without fault or improper conduct of his own, on or about the about the 10 day of June 1865 at Salsbaery in the State of North Carlina I found said Polston sick in camp he remained sick until the company was mustered out of the service. when we started for ____ for by rail Louisville Ky when we got to Louisville we carried him to a citizen Doctor. we then carried him by rail from Louisville to Bacon Creek Station in Hart County we then carried carried him 2 1/2 miles on horse back to his home and I know that the Dr called the Disease parcelis at the time. When in Service and I know that he is Still afflicted with the Same Disease of Leg I know these facts from beaing alon with him and from beaing from the time named and I have no interest whatever in the prosecution of this claim for pension his Two Witnesses George W. State of Washin, who, being duly sworn, declares in relation to the aforesaid claim that his age is ___years; that he is the identical person who served as a Capt in Co. H, 26 Reg't Ky Vols., and knows the above soldier, who was a member of Co. H, 26 Reg't Ky: that on or about ____day of____1868, while in the line of duty said soldier icurred severe sickness I believe it was at or near Salisbury N.C. in the year 1865 and I am satisfied he had to be carried from one car to the other while in rout from Salisberry N C to Louisville Ky to be mustered out of service in July 1865. I have made a certificate in relation to this claim before though perhaps not quite so definite as the above. Affiant further declares that he has no interest, direct or indirect, in this claim. and that he makes the above statement from personal knowledge and being in command of the detachment at that time. Dyer a resident of Vanfleet in the County of Hart State of Kentucky late private of Co I of the 26 Regiment of Kentucky Vol inft an oath, depose and say, that I was well acquainted with James Polston late a private in Company H of the 26th regiment of Kentucky Vol inft of the war of 1861: that at the time of his enlistment said James Polston was free from paralysis of left side, and to all appearance physically sound and while in the military service of the United States in the line of his duty, and without fault or improper conduct of his arm, on or about the fifteenth day of June 1865 at Sarlisbury in the state of North Carolina He contracted fever and said disease settled in his left side causing paralysis, He's left arm perishing to a considerable extent and his left leg breaking out in running sores and rendering said limbs almost useless and he was taken away from the regiment in the above condition and I found him thus when I first saw him after he was discharged.
