WILL BOOK C, P. 71

In the name of God Amen - I Claiborne Collier of the County of Henderson and State of 
Kentucky, do make and declare this my last will and Testament, in manner and form following 

First. I I resign my soul into the hands of Almighty God, hoping and believing in a 
remission of my sins by merits and mediation of Jesus Christ - And my boddy I committ to the 
earth to be buried at the discretion of my Executor herein after named. And my worldly 
Estate I give and devise as follows.

1st. I desire all my just debts to be paid out of my Estate.

2nd. I do give and bequeath unto my wife Matilda Collier, one negro man named William and 
one negro woman called and known by the name of Eliza, one tract or parcel of land 
containing 50 acres whereon J.C. Collier now lives, and all the other real property goods 
and chattels to remain in her hands during her natural life.

3rd. I do give and bequeath unto my son Theodore Collier 50 acres of land whereon I now live 
at the decd. of my wife, Matilda Collier to have and to hold to his benefit forever.

4th. I do give and bequeath to my daughter Obedience O. Sandefur to be recieved after the 
decd. of my wife Matilda Collier one hundred dollars.

5th. I do give and bequeath unto my son John G. Collier 25 dollars to be recieved after the 
decd. of his mother.

6th. I do hereby give and bequeath to my daughter Safrona Risley one hundred dollars to be 
recieved after the death of her mother.
6th [again]. I do give and bequeathto my son Joseph R. Collier one hundred acres of land, 
whereon Edward H. Biggs now lives. 

7th. I confirm unto Edward H. Biggs and his wife Amanda L. Biggs 50 acres of land which they 
now have in possession.

8th. I do hereby confirm to my son James C. Collier one hundred acres of land whereon he now 
resides. 

9th. I do give and bequeath to my four children viz. Elizabeth Lewis, Matilda M. Biggs, 
Washington F. Collier and Martha C. Collier all the  remaining property afer the foregoing 
legacies are paid off at the final  close of my estate shall be equally divided between them 
four. 

10th. I do give and bequeath to my son Albert G. Collier one dollar. 

11. I do give and bequeath to my daughter Malinda OhNeal [O'Neal] one dollar.

Lastly I do hereby appoint in my last will and testament my wife Matilda Collier executrix 
to this my last will and Testament. I do also request the County Court not to bind my wife 
Matilda in Security in her performance and duty. In witness whereof I hereunti affix my name 
this September 7th 1846.

Signed, sealed, published and declared by the said testator as and for his last will and 
testament in presents of us, who at his request in his presence and in the presence of each 
other, have subscribed our names as witnesses thereunto.

This last will and Testament of Claiborne Collier decd. was produced in court and proved in 
open court,according to law, by the oaths of James Jordan and Franklin Brown subscribing 
witnesses thereto and ordered to be recorded.

[Claiborne Collier and wife Matilda Duncan came to Henderson Co., Ky. ca. 1820, from 
Nicholas Co., Ky. I don't have their marriage date. Claiborne was born in Charlotte Co., 
Va., son of John Collier (will Nicholas Co. 1820) and Hannah Hamlett. Matilda was the dau. 
of Joseph Duncan, from  Fauquier Co., Va.,; (will Harrison Co., Ky 1822). [Submitter: Ed
