I David Sights of the County of Henderson and State of Kentucky. Now in perfect health mind and memory thanks to almighty God for the same and knowing the mortality of all mankind and that it is appointed to all men to die. I do here by make this my last Will and testament in manner and form following: 1st that all my real and personal estate be sold after my death and that all my just debts and funeral expenses paid 2nd I give unto my daughter Matilda A. Brown one hundred and twenty eight dollars. 3rd I give unto my daughter Mary I. Melton one hundred and twenty eight dollars. 4th I give unto my daughter Dorcas M Green one hundred and twenty eight dollars. 5th I give unto my daughter Isabellah U Cayry one hundred and seventy eight dollars 6th I give unto my son Lenard I Sights twenty five dollars 7th all the rest of my estate I desire may be equally divided among all my children which I give to them their heirs, executors, administrators and assigns forever. and lastly I do hereby constitute and appoint my friends George A. Sights and Isham Cottingham Executors of this my last will testament here by revoking all other or former Wills or testaments by me here to fore made in witness whereof I have hereunto set my hand and affixed by Seal this 11 August 1859, his Signed Sealed published and declared as and for David X Sights the last will & testament of the above named David mark Sights in the presence of us Attest I.H. Cottingham H Dunekake The Commonwealth of Kentucky To C.T. Taylor an examiner in the City of Louisville, Jefferson County Kentucky Greetings Know ye that we trusting to your fidelity and provident circumspection in examining Henry Dunekake a subscribing witness to the writing hereunto annexed purporting to be the last will and testament of David Sights deceased who recently departed this life in the county of Henderson in Said Commonwealth. We command you that on such certain day and place as you shall think fit the witness aforesaid you do call and cause to come before you and him diligently examine on oath whether the said testator signed and published the said writing hereunto annexed as his last will and testament or whether some other person signed it by his direction; whether he was at the time of disposing mind and memory and whether he subscribed his name thereto in his presence ant at his request and his examination when so taken you will plainly certify and send inclosing therewith the said writing and this commission, to the presiding Judge of our said county court in the town of Henderson, Witness James P Breckinridge clerk of our Said court at Henderson this 28th day of February A.D. 1867 James P Breckenridge C.H.C.C. In obedience to the above commission I C. T. Taylor examiner for Jefferson County Ky did on the 13th day of March 1867, did cause to appear before me Henry Dunekake who says on oath that he is the identical person whos name is affixed to the hereunto annexed purporting to be the last Will and testament of David Sights deceased affiant further says that he subscribed his name thereto as a subscribing witness at this instance and request and in the presence of the said David Sights. Futher says that the name of David Sights was written he thinks by Mr Isham Cottingham and that said Sights made his mark thereto in the presence of this affiant and that said Sights did thereby sign and publish the writing hereunto annexed as his last Will and testament. Futher says that said Sights was at the time of the signing & publishing the same of disposing mind and memory. DAVID SIGHTS WILL Continued Will Book C Page 238, Henderson County, KY H. Dunekake State of Kentucky Jefferson County I Charles T. Taylor Examiner for Jefferson County do certify that Henry Dunekake whos name is subscribed the the foregoing and annexed affidavit did personally appear before me at my office No. 161 West Jefferson Street in the City of Louisville State of Kentucky who being first sworn by me that the statements he should make in relation to the annexed instrument of writing should be the truth the whole truth & nothing but the truth. I futher certify that the same was read to and subscribed by him in my presence and that his statements were reduced to writing by me in his presence Given under by hand this 13th day of March 1867 C.T. Taylor Examiner State of Kentucky Henderson County Sct May County Court 1867 The last Will and Testament of David Sights decd was produced in court and proved in open court by IH Cottingham a subscribing witness thereto and H.
