From the Packet recieved from National Archives, Military Records from the Civil War State of Kentucky, county of Jefferson, In claim N. 869760 for Pension by Mary A. HORTENBERRY on this 7 day of August 1907 personally appeared before me a notary Public in and for the county and state aforesaid, Sarah HAZELWOOD aged 50 years, and whose post office address is 1021 Story Avenue and Louisville KY. who being duly sworn, according to law declare I knew Felix HORTENBERRY all of my life and remember him fromt he time he become of a marriageable age and I know that the said Felix HORTENBERRY was not married prior to hi marriage I have known the claimant all of our lives and state from personal knowledge that Mary A. MURPHY now HORTENBERRY was not married prior to her marriage to Felix HORTENBERRY they were never divorced but lived together as husband and wife until his death. the claimant has no property and no income except from her own labor no one is under obligation to contribute to her support. She futher declare that she has no interest in said case she is not concerned in its prosecution. signed by Sarah HAZELWOOD War of the Rebellion Declaration for a pension State of Kentukcy county of Spencer, on the 5th day of July A. D. one thousand eith hundred and ninety personally appeared before me a deputy clerk within and for the county and state aforesaid Felix HORTENBERRY age 49 years a resident of Harrisonville, County of Shelby, state of KY who being duly sworn according to law, declares that he is the indentical Felix HORTENBERRY who was enrolled as a Private on the 7th day of November, 1861 in Company D. of the 6 Regiment of KY Inf. Vols. commanded by H. C. WHITAKER and who honorably discharged at Nashville, Tenasee on the 31st day of December 1864. That his occupation is that of a farmer. That by reason of disability not due to his own vicious habits he is incapacitated for the performance of manual labor, and is without other adequate means of support. He further sates that he has an application for pension under the old law now pending in the Departement numbered 769, 231 He therefore makes this declaration for the purpose of being placed on the pension roll of the United States, under act kof Congress approved June 27, 1890 and hereby appoints, with full power substitution and revocation, I. HORTENBERRY on this 1st day of June, 1907, personally appeared before me a notary public in and for the county and state aforesaid, James HAZELWOOD aged 55 years, and whose post-office address is 1021 Story Avenue, Louisville, KY, aged________years and whose post-office address is _______ who being duly sworn, according to law, declares that he was well and ???????? acquainted with Felix WHORTENBERRY, and Mary Ann MURPHY from the time they become of a marriageable until they were married, I was present and saw them married, I know they were never divorced but lived together as husband and wife until his death. The claimant Mary A. HORTENBERRY has no property and no income she is entirely dependent upon her own labor for her support. Felix HORTENBERRY could not read or write and this is why his name begins with W. in the Marriage certificate, I suppose he was always called Felix HORTENBERRY and I know he is the same man who served in Co. D. 6 ??? KY Inf. he was a soldier when he married and allthough I was a child I remember his coming home and marrying. My brother come home with him. (stamp at bottom of paper says Pension U. S. office June 6, 1907.
