John LEWIS. Below is the will of John BURKS, brother to Amey BURKS DUNN. If I was going to speculate my guess might be that this family belonged to the John BIRKS above who arrives so early as he is the one that seems more closely associated with Bullitt Co. ( but that is simply a guess). 2 Jan 1832 Jefferson Co. Will Book 2 p. 457. Will of John BURKS "in good health at present time but having within the last eighteen months past had several attacks of a disease of dangerous nature" gives all his property real and personal to brothers James BURKS and Samuel BURKS except that otherwise bequeathed. Appoints James and Samuel as executors and asks that they punctually pay all just debts. Gives to sister Polly WILLIAMS $1,000.00. To sister Sally PHELPS $1,000.00. To sister Amey DUNN $1,000.00 during her life and should she die before testator the same to her two youngest children Francis and Emily DUNN or to them after their mother's death. To sister Betsey READ $1,000.00, and with a part of this money the executors to buy a negro woman, and after sister's death, the negro woman and increase to descend to her heirs begotten of her. The money to be paid within 18 months, but if that amount of cash and cash notes on solvent persons is not readily available to be paid within the next two years. If testator's illegitimate son, Perry BURKS, by Lydia SHAIN, should at the expiration of five years produce to the county Court five respectable persons who will testify on oath that his conduct for the said five years has been that of a sober, industrious and temperate man who has generally kept good company and conducted himself like a good member of society, then executors shall pay over to him $1,000.00 a year for three years; if he should be due, his heirs to have no benefit provided he is single and has no children, but should he marry and have children, they are to have the same benefits from the estate. To the illegitimate child Nancy, by Nancy SMYSER, now an infant, a negro girl who has been in the possession of her mother for two years past named Statia, also a negro girl named Rebecca, daughter of Bill and Sarah should said infant not live to full age and die without heirs lawfully begotten of her, then the two negroes and their children, if any, to go to infant's mother, and should the said mother die without heirs begotten of her, the said negroes and their increase to revert to executors. Testator asks that, within three moths, the negroes James the stiller, Petio, Charles the mulatto boy, son of Rachel, Cynthia HARRIS, wife of John be freed and emancipated. Executors to provide surety for good behavior, and send them to some place in the United States where they can be regularly emancipated, and if executors do not do so within six months, testator offers to any person who will interfere and emancipate them the sum of $300.00 on each slave they may emancipate, but no person shall interfere within the said six months. To nephew James PHELPS, the negro boy Emanuel, son of Simon and Jemima and also negro boy Tom, son of Simon and Jemima. Entreats James PHELPS to treat Emanuel kindly and not part with him except by necessity as testator particularly attached to Emanuel. Balance of the property to go to brothers James and Samuel. James to get bookcase and library, furniture and the clock. Asks to be buried alongside his father and mother in Bullitt County, and that there be a strong stone wall put around the graves and for room to be left to bury as many of the family there as may wish it. He hopes that Mr. PHELPS, who is now owner the land will have no objection to same.. Should any family member try to contest the will then their shares to go to James and Samuel. Witnessed by John ANDERSON, George W. CHAMBERS and Tucker LIVELY. Probated 2 Jan 1832 William POPE and Larz ANDERSON sureties for bond.
