Waggener See Order Book page 232.) Jefferson County: County Clerk: Wills 1784-1846: Roll No. 588537: Kentucky State Library and Archives Vol.3: pg.3 I Peter Newkirk of Jefferson County and the State of Kentucky, being of Sound mind and disposing memory do ordain this as my last will and Testament in words and manner as follow: 1st. After all my debts are paid, I give and bequeath to my son Thomas Newkirk, Ninety acres of my farm in Jefferson County on Pensylvanin Run. And to my Son Pearson Newkirk, Fifty acres herein alloted to Pearson to be laid off on the East side of the farm So as to include a Spring near where a School House Now Stands-- --If the aforesaid farm Should be found to Contain more or less than one hundred and forty acres the excess or deficiency to be proportioned between the before mentioned Thomas and Pearson, but these bequest are not designed to interfere with my Widow's right of Dower to which she is entitled, wherefore Said farm is not to be divided between Thomas and Pearson until after her decease without her consent. 2d to my wife Polly I allow a Dun Mare One Cow Such as she may select one third of the Hogs and one third of the Sheeps and farming utensils such as she may need. 3d to Thomas Newkirk I give a Sorrel Mare and a saddle & to Pearson I give a bay mare colt two years old next spring. 4th To my Daughters Kesiah, Jemima I give each a cow and bed furnished. All property of every description of which I may die possessed to be sold and the Money arising therefrom to be equally divided among my children (viz) Capander Appelgate, Leary Scott, Polly Fisher, Elizabeth Kelly, Jimima, Kesiah, William & Boone with the exception that Boone Newkirk I give additional to his proportion out of the above cow. I appoint Robert Gailbreath and Leven Cooper my Executors to execute this will. If my sons Thomas Newkirk and Pearson cannot agree on a division of the farm willed to them herein the division is to be made in the Most suitable Manner by my executors. In Witness whereof I have hereunto set my hand and seal this 4th day of December 1833. The within and foregoing Instrument of Writing was established by the Court as, and for the last Will and Testament of the Said Peter Newkirk deed and ordered to be recorded and is recorded , And Upon the Motion of Robt. Gailbreath one of the Executors Names in Said will who made oath according to law Execurtion of the said Will is granted him, Whereupon he gave bond with Thomas Newkirk his Security in the penalty of five hundred dollars Conditioned according to law.
