Ordered that Captain Hugh Chrisman and Robert Spears be appointed to allot the hands to work on the precincts of the road leading from the seat of Justice to Shriver Mill on which Charley Gates and Joshua Hudson are appointed surveyors.. Present William Price & Gent Justice Ordered that the County of Jessamine be divided into Pattrotte districts Two on the east and two on the west side of the Hickman road the boundary of the western districts are as Follows the road leading from the seat of Justice to Lambs Mill the Northern Boundary of the lower district and to be bounded on the other three Sides by the County line, on the west & south and the said road on the east the upper on the district road to Lexington bounded by the County Line on the west and south [ ] Page 88 [ ] Follows the upper district Bounded on the south by the road leading to Shrivers Mill from seat of Justice on the east and north by County Line and by the Hickman road on the West the lower district Bounded by the County Line on south and east and by Hickman road on the west by the above mentioned road leading from Seat of Justice to Shrivers Mill on the North. Ordered that John Wharton be appointed Captain of the patrol Company to Consist of James Williams, Samuel Wells & Charles Pigman for the upper district on the west side of the hickman road to Patrol 36 hours in the first month of their appointment and 17 hours in the remaining 11 months of their appointment. Ordered that Woodford Curd be appointed Captain of the patrol Company to consist of Lindsey Martin, Stephen Lewis, and John White for the lower district on the west side of hickman road to patrol 36 hours in the first month of their appointment and 12 hours in the remaining 11 months during their appointment. June County Court 1800 Page 105 Ordered that Charles West, John Freeman and Jonas Davenport be appointed to allot their hands to work on the Hickman road from the Fourteen to Eighteen mile tree on which Seth Thurston is appointed Surveyor. Ordered that James Webb Jr. pay Robert Shanklin two Shillings and a penny for his attending one day as a Witness for him and Howard. Ordered that James Webb pay Alden Webb four Shillings and two pennys for his attending two days as a Witness for him and Sarah Howard. Ordered that James Webb Jr. pay James Webb Sr. Four Shillings & two pence for his attending two days as a Witness for him and Sarah Howard. Ordered that a license be granted Susanna Speed to keep a Tavern at her house in this County upon her giving Security where upon she together with Francis Lowens, Martin Dickerson her Securitys entered into and acknowledged class Bond in the penalty of 650 Conditions or the [ ]. Page 106 Ordered that Patrick Gray of the County - proceed to collect the different sums assigned to the names of those who became subscribers to the establishment of the Seal of Justice for the County aforesaid on the lawn of Thomas Caldwell and Charly Gates at the Blacksmith shop of said Caldwell on the Hickman raod and if necessary to institute such for the recovery of the aforesaid respective sums. A subpoena for the proprietors of land through which a road leaving from the seat of Justice to Lamb mill is proposed to surrender have made the Following report For it. We the subscribers being appointed by the court of Jassamine to view a way for a road from the seat of Justice in said County to Lambs Mill - have after complying with the regulations of law, proceeded to view said Way Beginning at Main crop street in the Town of Nicholasville and from there through the land of Thomas Caldwell and then along the line of Archer Dickerson and John Greathouse to Abraham Houser. [ ] Page 107 And Jarvis Dunn and there to Andrew [ ] from thence Thomas Wood's land thence through George Ramsey's thence through William Grices thence thro Thomas Stools thence through Walter Cunningham's to the mile Geo Ramsey, Archer Dickerson Thomas Nicholson his Woods was returned. Executed to and being solemnly called [ ] nor any person for them and no objection being made by any person to the establishment of said raod It is ordered by the Court that the same be established a public road accessing to the above report. Ordered that Thomas Jeffers be appointed surveyor of the road leading from the seat of Justice to Lambs Mill as far as Curds road and that Thomas Caldwell and Benjamin Nickolson be appointed to allot the hands to work on the above precinct. Ordered that Thomas Woods be appointed Surveyor of the road leading from the seat of Justice to Lauton Mill from the Curd road to [ ]. Page 108 Ordered that the clerk of this county furnish a list of overseers of road, and persons licensed to Keep Tavern in this county to every Grand Jury. Prison Bounds established as follows [ ] Beginning at the south east corner of the Jail thence along the range of lots west of Mulberry Street about so far as a line running eastwardly will include the public well to intersect Main street thence with Main street to First crop street thence with [ ] street to the east boundary of Town running so as to include the public Spring thence along Main Crop Street Main Street Thence along main street to third Crop Street thence with [ ] third street to the west boundary thence along said boundary to the Beginning. An Indenture of Bargain and sale between James Buford all in fact for James Bramble of the one part and William Shreiver of the other part was acknowledged in Court by the said James Buford attorney as aforesaid to be [ ]. Page 110 An Indenture of Bargain and sale between James Jolliff and Elizabeth his wife of the one part and David Taylor of the other part was proven in Court by the oaths of Theorick [B. Ruffin Aron Blakeman & John Taylor Subscribing Witnesses thereto ordered to record. Ordered that Edmond Bryant be appointed Surveyor of the road leading from Clays mill to Livingston in Lexington of Augustine Galewood and to call on the hands formerly allotted to said Galewood to work on the above precinct. Ordered that James McCabe be appointed Surveyor of the Beckman road from the Fourteen to Eighteen mile tree on said road in the room of Seth Thurston and to call on the hands Formerly allotted to said Thurston to work on the above precinct. Ordered that the former order of this Court appointing Sarah Howard Guardian to Caty Sally Reed be rescinded. Certificate is Granted them for obtaining letters of administration on the estate of William Bowling Deceased upon their giving security whereupon they together with James Banter and Alexander Willoughby their securities entered into and acknowledged their bond in the penalty of one Thousand pounds conditioned [ ]. Ordered that William Shreve, Thomas Rukett, Nathan Baker and Samuel Reeds or any three of them, being First duly sworn do appraise in current money the personal estate and slaves of any of William Bowling Deceased and return that appraisement to district Court. Ordered that Thomas Robards, Phillip Webber, Patrick Gray, Richard Young & William Anderson meet at Johnson Tavern on the first Saturday in September to agree on the allotment of hands to work on the Following road [ ] Clays Mill road, First and second precinct hickman road [ ] road and silver creek Road. October County Court 1800 Page 118 By consent of James [ ] It is ordered that Patrick Gray and James Dudgeoss be authorized to hire out all the Negroes of John Dickson Deceased to any person they may think proper without advertising the same. On the motion of Joel Rice by Perry W. Humphrey his allowance It is ordered that the clerk of this court direct his warrant to William [ ] James Johnson and Roger Patton Commissioners appointed to the court pursuant to an act of assembly [ ] an act to reduce into one the Several acts to [ ] this Boundary of and [ ] Lands requiring them to attend the said [ ] at the beginning corner of a survey made for him by virtue of a [ ] Treasury, [ ] 1878, entered the second day of October 1780 on a large [ ] branch of hickman creek on the 20th day of November [ ] if fair if not fair on the succeeding day then and there to proceed agreeably to the above recited act and therein to abide as long as the [ ] this case requires and to make [ ]. It is considered By the court that the Judgment aforesaid be confirmed and that the [ ] sum of [ ] with [ ] his defense on this behalf expended and their is appealed [ ]. Ordered that William Lewis and Thomas Caldwell Esquires be appointed Judges of the approaching Election to elect Electors to elect a president & Vice president of the United States. John McKinney Is appointed their clerk. Ordered the the same persons formerly appointed by this court to allot the [ ] Page 120 An Indenture of bargain and sale between Anthony Sadowsky and others of the one part and John Lowery of the other part was produced in court and fully proven by the oath of Abram Fulkerson one of the subscribing thereto I ordered to record. An Indenture of bargain and sale between Anthony Sadowsky of the one part and Benjamin Blackfort of the other part was produced in court and fully proven by Abram Fulkerson one of the subscribing [ ]. On the motion of Samuel H. [ ] clerk of the court John McKinney [ ] Several [ ] prescribed by the court [ ] of this and of the united states and the specific oath pointed out by the act of assembly in that case made provided. Ordered that the court adjourn court in course. Will Lewis [ ] Page 127 Ordered that the sheriff of this county collect of each Tithable within this county two shillings each and account for the same as directed by law. Ordered that Thomas Caldwell be allowed Five pounds Five Shillings as for account [ ]. [ ] This day came the parties aforesaid by their attorneys and having heard the evidence produced by the parties and the arguments of their attorneys It is considered by the court the Judgment aforesaid that appellants receive [ ] the sum of three pounds three shillings together with his cash by him about his seal in this behalf expended & [ ] In the trial of the above appeal the following bill of exception was ordered. [ ] Page 128 [ ]off in which among other demands the [ ] was allowed and also went into Testimony to prove that the said discount of six pounds was improperly allowed in that court only a part of which having been paid by [ ] by his counsel did object to the court that they ought not to receive any [ ] to that effect or any other which would go to disprove and contradict the record of the said Court of [ ]. But the Court overrules the objection and it is ordered proof that the sum credit was legally admitted and did on such proof affirm the Judgment of the Magistrate to which opinion of the Court the said Counsel for the appellant did accept and [ ] that the Court on a majority of this magistrates these present would seal this his bill of exceptions but this Court wholly refusing so to do James Johnson [ ] Young and William Shrieve [ ] being registered by the Counsel for the appellant did set their names and seals hereto in presence of the Court according to the act of assembly in such cases [ ]. Page 129 Of a [ ] bond of the appellant look-up said bond and obtained on the back of said bond a full discharge by the oversight of the constable and obtained a full order in the Court of Quarter Sessions of Fayette in a suit brought by the appellant against the appellant when the appellant had only discharged to the constable a small part of said bond. Ordered that it be certified to the Governor of this Commonwealth that William Lewis, Thomas Caldwell, two of the oldest magistrates of Justice of the present qualifies to act as sheriff of this County. Page 130 This day to show cause of any [ ] could why an Order by which if he was appointed Guardian to Sally and Keally Reid should not be rescinded, appeared agreeably to the requisitions of the said Order and on consideration of the case It is ordered that the former order of the Court by which the appointment was made be confirmed. [ ] William Lewis Esquire On the motion of Richard Hightower It is ordered that he be permitted to keep a [ ] At his house in this County for [ ] months from this date and from thence until the next County Court upon his entering into bond as required by law [ ] Archibald Brislow his security [ ] together with the said Brislow entered into and acknowledged their bond as required by law. Signed Thomas Caldwell Page 131 Tuesday the 19th day of November 1800 The Court will agreeably to adjournment Present Thomas Caldwell Peter Higbee Esquires And Samuel Morris I Patrick Gray deputy sheriff of Jassamine County for Charles West sheriff made oath that [ ] the amount of Benjamin [ ] due from said [ ] in the year 1794, his has been and [ ] to collect [ ] and that as to the balance thereof the said Benjamin [ ] is his bond which is ordered to be certified (at the request of said Patrick Gody to Gwinn R. Tompkins sheriff Fayette County. [ ] Page 132 two born during the year 1800 supposed to be due for the year 1799. It is ordered that the said Patrick Gray refund to the said James Baker the liens thus is properly collected. John Dickerson Infant orphan orphan of John Dickerson deceased came into Court and with their approbation made choice of Patrick Gray as his guardian who together with Archer Dickerson his security executed their oath on the penalty of L400 conditions as required by law.
