BREEDEN -- AGREEMENT This Agreement made and Entered into this 18th day of April 1828 between Frances Breedin of the one part and her son John Breeden of the other part both of Shelby County aforesaid witnesseth that the said Francis Breeden in consideration of the natural Love and affection she has for her said son Elijah and the Covenant herein after contained upon his part She doth give, grant and Convey to the said son Elijah the farm and premises whereof they doth now live & to which she the said Francis has a life Estate being her dower in the land of which her husband Richard Breeden dec'd Seized possessed That is the said Elijah is to have use occupy and Enjoy said farm in as full a manner as the said Francis Could as herself and she the said Francis does hereby give & convey to her said son Elijah a negro boy named Ben or Benjamin and one Brown horse, three Cows, two heifers and twenty sheep And in consideration thereof the said Elijah Covenants and obliges himseslf to support his said mother Frances during the residue of her life in all necessary and common comforts suitable to her age and condition That is he is to furnish her with all necessary meat and drink and wearing appearel which can be produced from the farm and furnish all necessary medical assistance and aid and to support also in the same manner the little family his said mother may have and keep Said Frances is to have and occupy the house she now lives in with her family said Elijah is also to furnish all necessary wood and deliver the same at the house but is not to furnish tea sugar or coffee the said Frances retains a lein on all the property she hereby Conveys and the said Elijah is not to part therefrom or remove the Same from said farm during her life altho he is to have and use the same so long as he faithfully performs which he is bound to do by this agreement And at the death of said Francis then said Elijah is to have the full and absolute right to all the property hereby Conveyed The said Francis has a negro girl named Frances about twenty five years old which She retains for herself but which is to be under the direction and management of her said son Elijah whenever the said Frances the mother requests or requires the same but he is to have no right to Contract or direct said negro girl Frances against the Consent of his mother. G. Stout of Shelby County Kentucky the receipt whereof is hereby Ack'd he does by these Presents Grant bargain transfer Sell Convey and Deliver unto Milton S. Stout now Present & accepting and who hereby Acknowledges possession thereof all his undivided interest as one of the heirs of Richard Breedon formerly of Shelby County State of Kentucky dec'd in a Certain tract of land belonging to the Succession of the afs'd Rich'd Breedon dec'd Situated on Plum Creek in the County of Shelby State of Kentucky Containing 211 1/2 acres more or less bounded on the E by land belonging to the widow Alsy Turnham with all the buildings improvements warrants and defends unto the said Milton G. Stout his heirs and asigns All his rights or interest in to the aforesaid tract of land hereby Subrogating and transferring to the Said Purchaser all his rights of warranty and action so far as he himself is interested Against his vendor or all preceding vendors This done & passsed in the Town of Greensburg parish and State Aforesaid on this 8th day of March A D 1837 in the Presence of Henry Leonard & Wm H. Dobbs witnesses who have hereunto signed their names with the Parties and me the Said Judge & Notary. Mr. Breeden not knowing how to write has made his ordinary mark A part of the tract of Land above described is now in the possession of James Breedon brother of the aforesdaid Paul Breedon Attest his Henry Leonard Sam'l Leonard P. J. Paul (x) Breedon Wm Dobbs mark Shelby County Kentucky March 29th 1837 I do hereby transfer & assign to Josephus Turnham all the right title to this land mentioned in the foregoing title bond that is vested in me and do authorize him to receive a Conveyance to the Same Witness my hand & Seal the date Milton G.
