Besides, the summons, this was all that was included. No mention was made of a settlement. Fleming Co., KY Circuit Court Case #215 John Ross Ag } Bill J & B Hunt To the Honble the Judges of the Circuit Court of Fleming siting in Chancery. Your orater John Ross Humbly Shows That Some time ago a certain John Hunt Senr & Thomas Flowers made a Covenant with John Crittenden by which they purchased of the said Crittenden a large quantity of Land situate in different parts of this Comonwealth, that by Some fraud or other Circumstance unknown to your orator the said Crittenden vacatio? the said Contract and by the decree of the Court of Chancery the said Hunt & Flowers were order'd to reconvey the premises to the said John Crittenden; that after this decree of Cancell went had pas'd, the said John Hunt Senr Who your orator prays may be made a deft to this Bill proposed? to Sell to your orator one thousand acres of the Land which he said he had purchased of Crittenden & Concealed from your orater the decree which had cancell'd the agreement between himself & Crittenden that your orater purchased the said 1000 acres of Land from the said John Hunt & received the Bond of the said Jnofor the Conveyance thereto which will on a proper occasion be here to annexed; your orator shows farther that he assigned to the said Hunt in payment of the Land a bond held by your orater on a certain Benjn Lodges for the Sum of two hundred & fifty pounds p-?- money with fifteen years Interest thereon with a Credit for the -?- of three hundred dollars. Your Orater Shows farther that the said John Hunt the Deft, is notoriously insolvent & that he has long been in the habit of making sales of Lands & ther property to which he pretended title & as soon as he received any thing for such sales transfering the property received to Some of his sons, by which means the unguarded purchaser became compleatly defrauded of the price given, becausethe said John the Deft care fully avoided holding any thing which could be subject to Ex in [abbreviation for Execution?] and the son to whom his property was transfer'd pretended to be ignorant of the fraudulent practices of his father & to be a fair purchase of the property at an adequate price; Your orater Shows further that the said John Hunt the Deft in pursuance of hi Same practise -?- transfer'd the bond to his son Lewis Hunt who again transfered the bond to Basil Hunt for a trifling consideration -?- intended as a cover to the fraud than as a fair & adequate Consideration, and your orater expressly charges that both Lewis Hunt (who is since dead without issue or Exor) & Basil Hunt both at & before the times of the transfer aforesd to them had compleat notice that the contract between their father & Crittenden was sissolved that the bond on Lodges was procured from your orater by a pretended Sale of a part of the Said Land & that nothing Could ever pass to your orator by the Said purchase and also that their father was perfectly insolvent & as your orater believes intended to remain so. Your orater Shows farther that he has repeatedly applied himself to the said Basil Hunt (who he prays may be made a deft to this Bill) to cancel the said agreement and restore to him the Bond on Benj Lodges. But now to it is may it -?- -?- -?- that the said Basil Hunt Combining himself to & with the other deft John Hunt Senr & other unknown but who wen discover'd he prays may be the -?- defts with apt words to charge them refuses to restore to your orater the bond aforesd & cancel & annul the said bargain, but gives out in speches that your orater may seek his remedy against the said Deft John Hunt who he knows is insolvent All which actings and doings of the said Deft's are Contrary to Equity & lead to your orater -?- . I did not copy the judgement, which contained no additional genealogical information. A sale of the wards undivided 1/9 interest in the land was ordered. ______________________________ Fleming Circuit & County Sct Case #16058 John E. Harper vs/Pet. in Equity Samuel Farris & al Filed 1 Nov 1867 Fleming Circuit Ct. John E. Harper guardian of Nancy E. Harper, Robt W. Harper, Pltff. and Lucien B. Harper vs/ Pet. in Equity Samuel Farris, Levi Farris Harrison Farris, James C. Jackson and Lucinda his wife, late Farris Defts and George Tatman and Polly his wife late Tatman Plaintiff, John E. Harper, states that on the 18th day of September 1856, he intermarried with one Ducinia Farris, by whom he had three children viz: Nancy E. Harper, Robert W. & Lucien B. Harper. That thereafter, to wit: on the 10th day of May 1863 his wife departed this life in the county of Fleming state of Kentucky leaving his aforesaid children, and wards, as her heirs at law. That afterwards to wit: on the 7th day of March 1864, he again intermarried with one Nancy J. Farris, a siter to his former wife - and with whom he is still living in said couny and state. Plaintiff further states that by an order, at the Sept. term 1867, of the Fleming County Ct., he was duly and legally qualified as the guardian of his said children; which order is referred toand a certified copy of which will in due time be filed as part of this petition. Plaintiff states further that the mother of his said wards, was the daughter of one Levi Farris who departed this life intestate, in Fleming County Ky. on the day of July 1866. leaving no widow, but the following children (8 in all, now living, all of whom are grown and at the time of his decease over the age of 26 years, and whose names and residences are as follows: Samuel Farris and John E. Farris who reside in Fleming County Kentucky Lucinda Jackson, late Farris, who intermarried with one James C. Jackson, and who now resides in the county of Boone and state of Ind. Harrison Farris, who resides in Johnson Co. Kansas. Amanda Mitchell, late Farris, who intermarried with, and is now the widow of one Alfred Mitchell, and who resides in Nicholas County Ky. Levi Farris who also resides in Fleming Co., KY Polly Tatman, late Farris, who intermarried with one George Tatman, who reside in Robertson County Kentucky; and Nancy J. late Farris, and now the wife of Plaintiff. He states that said Levi Farris, deceased, was possessed in his own right, at the time of his death, of a tract of land containing about one hundred acres situated in the county of Fleming and State of Ky. on the waters of Fleming Creek worth about $1675- and bounded by the land of Samuel Rhodes on the east by Albert Gray on the west, by Elias Biddle in the North and by that of James Gray on the South. Said decedant possessed a deed for said land, a certified copy of which, will in due time be filed of this petition. Plaintif also further states, that at the August term 1866 (of the Fleming County Ct.) the defendant, Samuel Farris, qualified as Administrator of said decedent, and took out letters of administration. That decedent, left a very small personal estate, but sufficient to discharge his just debts, and funeral expenses, which have since been paid by his Administrator. He further states that Amanda Mitchell, and Nancy J-wife of plaintiff, have since the death of their father sold and disposed of their interest in said land, within brother Samuel and executed a deed of conveyance whin? for the same. No division of said land has ever been made (though he is informed that the other heirs are about to dispose of their interest) and the interest of his wards is the 1/9 of the whole trust, --which descended within from their grandfather,-the decedent. Plaintiff states that he verily believes that a sale of the interest of his said wards in said land will re-?- other benefits, as a division of the same, would render the share of each so small as to be of very little value. Wherefore, he prays for an order of warning against the non-resident defts--James C. Jackson & wife, and Harrison Farris, and for Judgment for sale the? of the undivided interest of his said wards and for all equitable relief in the premises. Thos. L. Given Atty for pltff. Waldeck, 91, Succumbs Thursday John Alexander Waldeck, 91, one of Lawrence county's oldest citizens and a resident of Louisa since 1865, died early Thursday morning at the home of his daughter, Mrs. Charles Ryan. Mr. Waldeck, who retired in 1929, had been in failing health the past two years. He suffered a cerebral hemorrhage Monday and grew gradually worse, succumbing at 3:45 a.m. Thursday. A son of Virginia parents who migrated to Eastern Kentucky a century ago, Mr. Waldeck was born at Paintsville, Ky., June 30, 1849, a son on Nicholas Carpenter Waldeck and Maria Dunlap Waldeck. The family moved to Blaine in 1850 and subsequently to farms at Fallsburg and Dean Bend, W. Va., and then settled in Louisa in 1865. At the age of 19, Mr. Waldeck in 1868 went to Gettaway, Ohio where he served four years apprenticeship in the tannery of his brother, James F. Waldeck. Having completed his apprenticeship, he returned to Louisa in 1872 and became associated with another brother, William Waldeck, in the operation of a tannery here. He later took over the management of the tannery and operated it for a number of years. It stood at the corner of Pocahontas and Pike streets. When the leather business declined, he closed the tannery and for a time worked with engineering crews and government dredge boat crews on Big Sandy river. From 1896 to 1918 he was associated with the Snyder Bros. Hardware here. In 1918 he took a position as toll keeper on the Louisa and Fort Gay bridge and held the position until he retired in 1929 at the age of 80. He became a Mason in 1872 and was a member of both the lodge and chapter in Louisa. Funeral will be conducted from the home of his daughter here Friday afternoon at 2:30 o'clock with Rev. T. J.
