JUDGE CARTER DEAD The sad news of the sudden death of one of our oldest citizens threw our little town into mourning Sunday morning. The first thing that met the peoples ears as they passed the Miller House where a large crowd having assembled, some preparing to go to berea to accompany the remains back to Mt Vernon others anxious to know what caused the sad misfortuen was "Judge Carter is dead". At the time of his death he was in Berea where had gone to deliver some degrees in Masonery one the Easter Star degree to some ladies. He was a Mason of high standing and throughly devoted to the workings of that order. He was often heard to say after he was forced to retire from active life on account of ill health and old age. "I have given up my law practice and everthing else except my Masony that I will never forsake". For fifty years he had been a member of this order. He was a strict member of the Baptist church for over 40 years. The funeral exercises took place from the Baptist church Monday at 10 am conducted by Rev J.C. Carmical. They returned that night and Tuesday morning Judge Cantrill instructed the jury. Following are the instructions in substance: Frist..That a conspiracy is a combination of two or more persons to do an unlawful act. That an accesory befor the fact is one who has knowledge of such conspiracy befor the actual crime is committed Second..that if the jury believes that Caleb Powers, with intent to bring about the death of Goebel, conspired to get Youtsey, Whitaker, Jim Howard, Berry Howard, Dick Combs or person or persons unknown to shoot the said Goebel, the defendant should be found guilty of murder and punishment fixed at death or at life imprisonment in the penitentiary Judge Cantrill limited the time for speaking to twelve hours to a side. it is thought that the case will go to the ury tomorrow. Davault says that W.A.B. Davis visited the schools in his section a few days ago and whilte there took supper with him. Mr Davault says he was astonished at the amount of suppoer he ate. He says it was pretty bad on him considering the tight times Dr Davis informs us that the firm of Colyer & Lewis have opened a coal bank theree miles south of town and that they have incorporated under the laws os Ancient coal miners. Collyer of this place, died of consumption. By request of the deceased the funer services were conducted by Rev Martin Owens, which took place at 3 o'clock on Monday Aug 13th. He leaves a wfe and two children whom he made an idel of. He will be missed as a worker in the Sunday school and church. He was the corner stone of both working continually in Christ. The sympathy of the entier town goes up in behalf of the bereaved family trusting his loss may be their gain I wish to thank my friends for their kindness toward me while my family has been so sick.
