Range no 3 for her sole use during her natural life ~ 3d I will that my two sons John and James shall have that part of my land which lies north of the above Crumes land being a part of the above section and if the same should not contain one hundred acres then they shall have what will make it up one hundred acres in the southeast corner of the other parcel of my land as above named for their use and behoof forever~ 4th I will that what moveable property there shall be left of mine after my debts are paid shall be given to my beloved wife for her own proper use during her life~ 5th I will that if there shall be any part of my property remaining after the decease of my wife that my two daughters Elizabeth and Jane shall have the former a cow and the latter a side saddle and a cow and if there should be anything left afterward that it shall be equally divided between my children 6th I will that after the decease of my wife all that part of my land which is not given to my two sons in this will shall be equally divided between my five daughters, to wit, Margaret, Sarah, Mary, Elizabeth & Jane~~ 7th And last I will that my wife Mary and my two sons John and James shall be my executors to execute this my last will and Testament in witness whereof I have hereunto set my hand and seal this 4th day of September One thousand eight hundred and four~ William Marks (his mark) Signed in the presence of Eleazar Burkhead Moses Crume Mary Burn At a county court held for Nelson County on Thursday the 15th day of November 1804 this last will and testament of William Marks decd was proved by the Oaths of Moses Crume and Mary Burn two of the subscribing witness thereto and sworn to by John Marks and James Marks two of the executors herein named and ordered to be recorded. ______________________________X-Message: #2 Date: Sat, 12 Feb 2000 14:47:15 -0600 From: "Lange" Subject: WILL: Marks, 1808, Nelson co In the name of God, Amen, I George Marks, Lew.? (Farmer) of the county of Nelson and State of Kentucky being in a very low state of health, but of sound mind and memory and knowing that it is once appointed by God for all men to die, do make this my last will and testament, first I recommend my soul to God, who gave it my body be buried in decent, Christian like manner, at the discretion of my executors, and as lacking such worldly estate wherewith it has pleased God to bless me within this life, it is my will and desire that I shall be desposed of in the following manner - I hereby appoint my dearly beloved wife Sarah my executrise and my true and trusty friends Jess Crume and Isaac Harrel (?) surveyor my executors - I further appoint my trusty friends Ralph Crume, Bennet Lucas and McClellen surveyors,all of Breckenridge County, to settle my ? and to sell any part or all of the lands I claim in sd county as they think proper and pay themselves for their troubles out of said lands, and it is further my will and desire that the money arrising from the sale of said lands may be by my executors converted to the use of paying my just debts and render the overplus to my beloved wife Sarah and two our dutiful sons Davis and George, likewise my dutiful daughter Susannah - It is further my will and desire that after my beloved wife Sarah hath received her third of my estate, that the remainder be equally divided between my three children Susannah, Davis and George. It is further my will and desire that all the property I hold in Nelson county, after my just debt are paid, remain in the possession of my beloved wife Sarah (unless she sees proper to have it sold) until my sons Davis and George come of age to legally heir an estate. It is further my will and desire that all the property heretofore given my daughter Susanna remain with her and be peacebly possessed by her and her heirs - But is is my will and desire that she shall receive no part of my lands, goods or chattels lying or being in the county of Nelson. It is further my will and desire that after my just debts are all paid the residue of lands goods, and chattels all dues, debts and demands to be equally divided between my beloved wife and sons, and be it known that all former wills and demises are by this made void. In the name of God Amen, I Benjamin Marks of the county of Nelson and state of Kentucky, being sick and weak in body but of perfect mind and memory do make this my last will and testament. I give and bequeath unto my wife Sarah all my lands (to wit). The tract whereon I now live which I bought of John Lewis containing two hundred acres; the Tract or parcel of land adjoining which I bought of John Awbrey containing seventy three acres, also twenty acres I bought of Awbrey and Butter, of the Sann Survey, and our house and acres lying in Breckenridge County on the North fork of bough Creek bought of William Harsen (Hansen?) together with rents and proceeds with all things pertaining thereto for her in the use of my family with all my personal property of every kind to have and to hold for the use of my family and schooling of my children to be held by her during her life or widowhood, and if she marrys there shall be a divide of all my lands and property of which she may possess. One third during her life and, after her death, it shall return to my children. It is my will and intention that after the death of my wife all my children shall have an equal proportion of my estate; George Marks, Isaac Marks, William Marks, John B. Marks, Susanna Marks, Benjamin Marks, Bluford B. Marks, Jacob C. Marks, and Sally S. Marks, and should any of my children marry or come of age so that they should need a part, to the amount they receive, they shall account to the estate a record to be kept by the executors. It is my intention that none of my land be sold for any of the above purposes and that my wife be restricted from the priviledge of trading to any amount over ten dollars without the advice and consent of my executors, I appoint Joseph Wilson and Abraham Birkhead executors of this my last will and testament in Testimony whereof I set my hand and seal this twenty seventh day of july one thousand eight hundred and eighteen.
