Witnesseth that whereas by the Decree aforesaid in the cause aforesaid the said Crooke as Commissioner was directed to Survey and divide the land of Richard Lee decd equally in value among all his heirs - he has done so as in his judgment seemeth right - the land is in Madison County on the Brushy Fork of Silver Creek containing 352 acres and the part of said tract of land laid off to the said Joel Todd and hereby conveyed is Lots No. 2, 3, 4, 5, 6, 9, 12, 14 and containing in the whole 169 [?] acres as per commissioner's report in the case he having purchased the interest of the said James Stephenson & wife, David Lee, James Lee, Irvine lee, Grisham Lee, David W. Dalton & Wife and Preston Forest & wife. Lots No. 2, 3, 4, 5, and 6 is bounded as follows to wit: Beginning at five red oaks corner to Lot No. 1 with a line of same West 171 poles to a Stake, white oak and chestnut _____ on the West line of the 352 acres, with a line of Same S2N96 = poles to a Stake on said line and corner to Lot No 7, with a line of same East 171 poles to a Stake on the East line of the 352 acres, with said line N2E96 = poles to the Beginning ____ 100 acres. Lot No 9 containing 22 acres, bounded as follows, to wit: Beginning at a Stake, dogwood, red oak and black gum ____ corner to Lot No 8, with a line of same West 171 poles to a red oak and sour wood with the old line S2W20 = poles to two hickories dogwood and chestnut corner to Lot No. 10, with a line of same East 171 poles to a Stake two Chestnut oaks ____ on a drain [?] with the old like N2E [?] 20 = poles to the Beginning. Lot No. 12 Containing 21 acres, bounded as follows, to wit: Beginning at a Stake, black oak pointer corner to Lot No 11, with a line of same West 171 poles to a Chestnut oak on the old line, with it S2 W20 poles to a large black oak with a line of Lot No 13 East 171 poles to a Stake and pointers on a drain with the old line N2E20 poles to the Beginning. Lot No. 14 containing 23 acres, bounded as follows, to-wit: Beginning at black locust on a hill side corner to Lot No. 13, with a line of same West 171 poles to a Stake three white oak pointers, with the old line S2 W 21 = poles to a Stake 4 white oaks pointers, corner to Lot No 15, with a line of ____ East 171 poles to a Stake two pines ____ on the old line with it N2E21 1/2 poles to the Beginning. Now the parties aforesaid of the first part by the Commissioner aforesaid hereby convey to the party of the Second part aforesaid all the title and interest in Said 169 acres of land which they have derived from heir ancestor Richard Lee, decd and the appurtenances belonging thereto. To have and to hold the same to him the said Todd and his heirs forever. The said Crooke acts as Commissioner and is not to be liable in any event whatever.
