Bellis 28 June 1824 (2 acres on the Main Somerset containing Grist and Sawmills) Nicholas County Courthouse Record Book F, page 481 This indenture made this 28th day of June in the year of our Lord one thousand eight hundred & twenty four between Walter Caldwell & Polly his wife, of the county of Bath, and John Carter Jr. & Elizabeth his wife of the County of Nicholas and State of Kentucky of the one part; and Phillip (sic) Bellis of the County of Nicholas & state aforesaid of the other part; witnesseth; That the said Caldwell and Carter for and in consideration of the sum of three hundred dollars, to them in hand paid, the recpt. whereof is hereby acknowledged, have granted, bargained & sold and by these presents do grant, bargain, sell, alien, convey and confirm unto the said Philip Bellis his Heirs & assigns one certain tract or parcel of land situate (sic), lying & being in the County of Nicholas and State aforesaid, on the waters of Maine (sic) Sumersett (sic) containing about Two acres more or less, and bounded as follows To-wit; Beginning at the mill house now owned by said Bellis on the land hereby conveyed; thence running down the creek about 20 ?10? poles to an Elm; Thence east about 10 poles to a Hickory; Thence about N 20 poles to a sugartree on the Bank of the creek above the said mill; Thence across the creek to the abutment on the opposite side from the mill; Thence to the Beginning, with a Sawmill & Grist mill built thereon, together with all and singular the premises and appurtinances (sic) thereunto belonging or in any wise appertaining; To have and to hold the said Tract or parcel of land & premise. With its appurtinances unto the said Philip Bellis his Heirs & assigns forever: and the said Walter Caldwell & Polly his wife & John Carter & Elizabeth his wife for themselves their Heirs, Executors, & Administrators the aforesaid Tract Lot or parcel of Land and premises with every of its appurtenances, unto the said Phillip Bellis his Heirs or assigns, from & against the claim or claims of themselves & their Heirs and from & against the claim or claim of all and every other person or persons whatsoever, do and will warrant and forever defend against these presents. In Testimony whereof the said Walter Caldwell & Polly his wife & John Carter & Elizabeth his wife have here unto set their hands and seals of the Day & Date first written. This deed of bargain & sale from Walter Caldwell & Polly his wife & John Carter & Elizabeth his wife to Phillip Bellis was this day produced to me in my office and acknowledged by the said Caldwell & Carter to be their act and deed for the uses & purposes therein mentioned. And the said Polly, on the date hereof, and she the said Elizabeth on the 28th of June 1825 being by me privately examined separate & apart from their said husbands, declared that they freely & voluntarily relinquished their right of Dower in and to lands within mentioned without the threats or persuasions of their said husbands. Between Jesse Wilson and Susannah Wilson his wife of Nicholas County and State of Kentucky of the one part, and Philip Bellis of the same County and State of the other part. Witnesseth, that the said Jesse Wilson and his wife for and in consideration of the sum of Twenty Dollars to them in hand paid the receipt of which is hereby acknowledged, have granted, bargained and sold and by these presents do convey and confirm unto the said Philip Bellis his heirs and assigns forever a certain tract or parcel of land situate in the county aforesaid on Somerset Creek and bounded as follows, towit, Beginning at Buckeye at ?G? (see plat of Division of the Land of Uriah Wilson decd. of record in the Nicholas County Court clerk office.) Thence N. 48° W. 58 poles to a stake corner to ?? Branch. Thence with Mrs. Thomas’s line S. 44 W. 41 ½ poles to a Stone on the creek. Then S. 48 E. 95 poles to a Sycamore in Swearingen’s line. Thence with it N. ?W.? 55 poles to the Beginning. Containing Twenty acres be the same more or less. (it being that portion of the tract of land in the possession of Uriah Wilson decd. at the time of his death and in the division of said land was allotted to Philip Bellis assignee of Abraham Kern ?? entermarried with Susannah Wilson one of the heirs of said Uriah dec. ?? said Jesse now holding the legal title thereto.) Together with all and singular the premises and appurtenances thereunto Belonging or in any wise appertaining. To have and to hold the said tract or parcel of Land and premises unto the said Philip Bellis his heirs and assigns forever. And the said Jesse Wilson and wife for themselves their heirs executors and administrators the said tract or parcel of land unto the said Philip Bellis his heirs or assignees against the claims or claims of all and every person whatsoever claiming or to claim through or under them do and will warrant and forever defend by these presents. ?? not warrant or defend against any other person or persons whatever the object and intention of this conveyance bring to place in said Bellis his heirs or assigns such legal title as the said Jesse Wilson has to said land without any recourse whatever on Wilson his heirs or in case of said land being lost or taken by any claims on ?? title to said Wilsons Title. In witnesses whereof the said Jesse Wilson and wife have hereunder set their hands and seals the date first above written. It appears to me that the legal transfer of title didn't take place until eleven years later. rb) Commonwealth of Kentucky Nicholas County to wit: I, I.G. Parks, Clerk of the County Court for the County aforesaid, do certify that the Deed from Jesse Wilson and Susannah Wilson his wife to Philip Bellis was on this day produced to me and my office and acknowledged by the said Jesse Wilson to be his act and deed. And the said Susannah Wilson being examined by me privately and apart from her said husband declared that she did freely and willingly seal and deliver said writing and wishes not to retract it; and acknowledged the said writing again shown and explained to her, to be her act and Deed, and consenteth that the same may be recorded.
