HELM of Hardin County of the second Part Witnesseth that whereas at the June Tern 1828 Benjamin HELM in the Hardin Circuit Court recorded a decree against John WELSHES heirs for the sale of certain mortgaged estate to satisfy the amount named in said decree and at the March Term 1833 of the said Court Thomas B. HELM obtained a decree against said WELSHs heirs to sell as much of Jns tracts of land - to wit- one tract of one hundred acres conveyed by John BELL to Alexander MERRIFIELD the other tract for 250 acres conveyed to said Alexander MERRIFIELD to said John WELSH and both of which tracts have been conveyed by said JOhn WELSH to Benjamin HELM in a mortgage on the 30th day of August 1822-- The decree in favor of said Thomas D. HELM being found upon a debt for a part of the purchase money of said land which had not been paid an under said decree of Thomas D. HELM Commisioner appointed under said decree did on the 17th day of June 1833 sell said two tracts of land with the exception of fifteen acres to be taken off of the mose easternly part of said two tracts as they lay adjoining each other, and Gabriel KIRKPATRICK became the purchaser As appears by the said Commisioners report-- and on the 28th day of September 1848 on motion of the said Benjamin HELM made in a suit of said Thomas D. HELM against John WELSHs heirs John DUNCAN was appointed a Commissioner to lay off 15 acres of land after the payment of the purchase money-- An on the further motion of the said Benjamin HELM made in the suit of himself against John Welshs heirs- Samuel HAYCRAFT was appointed to Convey to him or his order the fifteen acres left after satisfying the decree to Thomas D. HELM to be conveyed as soon as the survey was made by John DUNCAN And at the March Term 1849 of the said Hardin County Court the said John DUNCAN made a report which follows viz-- Thomas D. HELM Complaintant vs John WELSH's HEIRS Defendants In Compliance with an order of the Hardin County Court granted at the September Term 1848 I proceeded to survey and lay off fifteen acres of land out of the most eastwardly part of the 259 acre tract in the name of Alexander MERRIFIELD better known by the name of the WELSH tract which is bounded as follows: Beginning at two post oaksat the edge of the BARIN sink corner to John WELSHS 250 acre survey thence with his line N30W 50 poles to a stake in a BARRIN sink in said line thence S46W 54 1/2 poles to two black oaks thence S30E 50 1/2 poles to three willow oak in another line of said WELSHES thence with the same N46E 54 1/2 poles to the beginning March 14th 1849 John DUNCAN Comm Samuel WOODSON Chain carriers John DUNCAN (drawing of land laid off cannot reproduce) Which said tract of land now lies in Larue County and whereas at the June Term 1849 of the Hardin County Court by a written order of the said Benjamin HELM presented by him in open Court by an order of said Court made in the said suit of said Benjamin HELM against John WELSH;s the Commissioners was directed to make a deed to the said Henry B. HELM in place of his to said Benjamin HELM Now Therefore this Indenture Witnesseth thatthe said parties of the first part for and in consideration of the premises hath the day granted bargained and conveyed by these presents do grant bargain sell and convey to the said Henry B. HELM his heirs & etc the before described fifteen acres of land with all and singular the apurtenances thereunto belonging-- To Have and To Hold the same to Henry B. HELM was produced in Court by said Comissioner and acknowledged to be his act and deed and the same being examined & approved by the Court was ordered to be certified to the Clerk of the Larue County court for record Given under my hand this 24th day of September 1849 Samuel HAYCRAFT Clk Hardin Circuit Court I Stephen W.D. STONE Clerk of the Larue County Court Kentucky certify that on the 25th day of September 1849 The forgoing deed from John Welshs heirs by Com to Henry B.
