In the name of God Amen. I Aaron Phillips of the County of Laurel and State
of Kentucky being now of a sound mind do make and commit to record this my
last Will and Testament. 

To Wit. I wish to be plainly and desently buried when I die and secondly I
wish all my Just debts to be paid out of my personal estate. Thirdly I will
and bequeath to my oldest sons John Phillips and Stephen Phillips, the sons
of my first wife Hannah Phillips, one fifty dollar horse to each which they
have already received and fourthly I will and bequeath to my wife Polly
Phillips all my estate both real and personal during her natural life
provided she should not marry. But in case she should marry I will to my
said wife one third of my real estate during her natural life and at her
death I wish all my estate Equally divided between my son Aaron Jr. and my
daughters Betsy, Mary Ann and Rachael Phillips which are the children of my
last wife and my further wish and desire is that provided my said wife
should marry after my death that in addition to the one third of my real
estate that she shall have one horse beast worth sixty dollars, one bedd and
furniture one cow and calf together with all the cupboard and Kitchen
furniture to dispose of as she may think proper and further my wish and
desire is that all my surplus personal property at my death shall be sold at
a credit of twelve months taking from the purchasers Bond with good and
sufficient security and I further appoint my last said wife my Executrix of
this my last Will and Testament. In witness whereof I have here unto set my
hand and affixed my Seal this the Eighth day of March in the year of our
Lord 1843.

This Indenture of two parts made and entered into this 26th day of February
1855. I Aaron Phillips Sr. of the first having a will made which I do intend
to go on record after my death as my last Will and testament do covenant and
agree with Rachael Phillips my youngest daughter of the second part that I
do for the natural born affection I have for the said Rachael being
unmarried and yet living with me and to make her equal with the other
children give unto her the following species of property, viz, The gray mare
that I got by swaping with Ephraim Gains and her saddle and bridle, one
little red and white Sided(?) Cow, one steer and two little heifers, eight
head of sheep, six old ones and two lambs, one bed, beading and furniture.
Now I the said Aaron Phillips being the lawful owner of the above
named property do convey the title of same unto the said Rachael Phillips
free to dispose of at her own will and pleasure with the right to her
proportion of all my other property as directed in the will above named.
This given under my hand the day and date above written.

April Term 1855

A writing purporting to be the last Will and testament of Aaron Phillips
deceased was produced in court and proven by the oaths of James Bullock and
James Casteel(?). Also a codicil to said will was produced and proven by the
oaths of James Bullock and John Gains subscribing witnesses thereto. All of
which is ordered to be admitted to record. And which is hereby accordingly
done.
