The following article was published in the April 15, 1948, issue of The Mountain Eagle: Deputy Sheriff Hillard Bates Fatally Shot at Hemphill Hillard Bates well known county man was killed in a fight with Earl Bentley on Sunday evening about 9:00 EST. According to Sheriff Herman C. Combs he was called to the upper end of the county to quiet a disturbance between Bates and the Bentley's. He asked Bates for his resignation which he gave. Mr. Combs then left thinking every thing had quieted down coming back home he sat down to eat supper and the phone rang it being Bates who said "well they shot me but I am not killed I am too tough for that" then he was told that he need not come up as every thing was all right but he told him he would be right up. When he arrived Bates was sick and vomiting. He drove his car all around drank a soda and in general seemed to be sure that he was not fatally hurt. Bates died at midnight on Monday night of complications caused from the wound which went through his abdomen. Funeral services will be held at Whitaker today.
