WILLS: DOOLEY, George, Will 1821, Lincoln County, Kentucky Date: Tues, 3 Oct 2000 From: "Lauri Dooley Miller" Will of George Dooley Pages 144-147 Stanford, Lincoln County, Kentucky October, 1821 In the name of God amen I George Dooley of Lincoln County being at this time sick but of sound mind and disposing memory do make and publish this my last will and Testament. First my will and desire is that my Negroe (sic) woman Sarah and her Children, John, Hilliard, Lucinda, Rhoda, Malinda and Clark be and I do hereby Emancipate and let them free. 2nd I do hereby give and bequeath to my said Negro woman Sarah and her child John all My Tract of Land on which I now live lying on the South side of the public road during the life of said Sarah and at her death the whole of it is to go to said John and should said John die before the death of said Sarah it is my will that the said Land at the death of said Sarah be equally divided and I do hereby desire and give the said land to the aforesaid Hilliard, Lucinda, Rhoda, Malinda and Clark to them and their heirs forever 3rd It is my will and I do herby give and bequeath the balance of my said Tract of land on which I now live and lying on the north side of the road to my Mulatto Children Hilliard, Lucinda, Rhoda, Malinda and Clark to them and their heirs for ever and if either of them should die before they come of age the Survivors shall Succede (sic) to and inherit the same equally. 4th I do hereby devise to my sister Betsey Bibb my Negro woman Rachael and her two children Maria and Bill during the life of my said Sister and at the death of my said Sister Betsey Bibb It is my will and I do give the said Rachael and her present children Mariah and Bill and the future ___ of the said Rachael should she have any to the aforesaid Sarah and her children John, Hilliard, Lucinda, Rhoda, Malinda and Clark to them and their heirs forever. 5th My will and desire is that the balance of my Negroes to wit Landon, Molly, Peggy, Jim and Jude be sold upon a credit of twelve months, by my Executors, and the money arising therefrom be equally divided between the Children of George D. Bibb and Thomas Bibb reserving out of this fund fifty dollars per year for my Sister Betsy Bibb during her life which is to be reserved and paid over to her by any Executor during her life. 6th My will and desire is that my old Negro man Tom, Jr. and Bill be and I do hereby emancipate and set them free and to be kept out of the profit of my Estate. 7th The balance of my Estate whether real or personal I will to be sold and the money arising therefrom to be equally divided between the aforesaid Sarah and her children John, Hilliard, Lucinda, Rhoda, Malinda and Clark. 8th My will is that my Executor employ some person to superintend the cecased (sic) land and farm it for the benefit of the said Sarah and her children and pay such person out of the proceeds of the farm reserving however to the said Sarah and her children the houses, yard, garden and the lot of ground about the Stables supposed to be about ten acres and the orchard. 9th My will is that the said Rhoda, Malinda and Clark be placed out with some decent dependable family or familys (sic) until they are fourteen or fifteen years of age; and that the Executors take the proper covenants from the person or persons on whose hands the said children may be so placed, to treat them kindly, feed and cloth them well and learn them to read and write with this qualification that the mother Sarah may keep one of the girls to assist her if she chooses. 10th It is my will that if Sarah requests it that Hilliard be bound out by my Executors to learn some Trade: which will be usefulto him as a Mechanic 11th I do hereby give and desired to the aforesaid Sarah and her Children all the house hold and kitchen furniture for the use and benefit of said children 12th It is my will that if any debt due or demand should come against my Estate that the same be satisfied out of the personal Estate or the money arising from the Sale of the negroes (sic), but under no pretense whatever is the said Sarah and her children, John, Hilliard, Lucinda, Malinda, Rhoda and Clark for any manner interrupted in their freedom. My will is that my Executors place Lucinda under the care of Thomas Helm of Stanford and that the said Thomas Helm learn or cause her to be learned to read and write, to knit and sew and spin and that she continue with him until she arrives to the age of fifteen or 16 years as he may choose. My stock of every description is to be continued on the farm for the use of Sarah and her children except the sheep which are to be sold except eight or ten which is also reserved for said Sarah and her family. Lastly I do hereby nominate constitute and appoint Samuel Craig, Beckham Kelly and Peter Carter Executors of this my last will and Testament hereby revoking all others. In testimony where of I have hereunto set my hand and seal this third day of October 1821 underlined before signed. Acknowledged in Presence of Thomas Helm George Dooley (Seal) John (his mark) McMurry Codicil In explanation of the fourth Item of my will I do hereby qualify the same in this way that there shall be bond with good Siesenty give to my Executors before my Sister Sarah (sic) receives the Negro woman Rachael and her two Children Mariah and Bill that the said Rachael and her children shall not be removed out of Lincoln County and should there by any attempt to remove them even after the Execution of the bond in that case the said Sarah and her children shall immediately received and take the said Negro Rachael and Mariah and Bill into their possession And it is further my will and desired that if there should be any Interest arising from my monies which may come into my Executors hands that my Executors pay the same over to my Negro woman Sarah for her own benefit In Witness whereof I have hereunto set my hand and seal this ninth day of Octover 1821 Witness Thomas Helm George Dooley (seal) William Hughs Second Codicil It is my will and I do hereby make the following alteration in the fifth Item of my will towit that the money arising from the sale of Landon, Molly, Peggy, Jim and Jude shall be and I do hereby desired and give the same to the Children of George D. Bibb towit Caroline Bibb, Jerome Bibb and Dooley Bibb each two hundred dollars per year for the space of twelve years. Should there be as much money arising from the Sale of the Said Landon, Molly, Peggy, Jim and Jude but my debts are to be first paid out of this fund. Thomas Helm George Dooley (seal) William Hughs Kentucky Lincoln County Court At a county Court held for Lincoln County on Monday the tenth day of December, 1821 The last will and Testament of George Dooley deceased was exhibited unto the Court and Thomas Bibb and Betsy his wife who claim to be the heirs at Law of the said George Dooley deceased appeared in Court by George Robertson Esquire their attorney with and opposed the establishing and recording of said will. Whereupon on the motion of the said Thomas Bibb and Betsey his wife it is ordered that the further consideration of the said will be postponed and continue until the next term of this Court. 2nd at a County Court holden for Lincoln County on Monday the fourteenth day of January in the year 1822 The last will and Testament of George Dooly (sic) deceased which was exhibited into Court at the last Term thereof was again produced in court and Thomas Helm, John McMurry and William Hughs, the subscribing witness to the said Will and Codicils were sworn and examined and sundry other persons sworn and examined touching the competency of the said George Dooley deceased to make and publish his last will and publish Testament and _____ codicil it is ordered that the further consideration thereof be continued over until tomorrow. And at a County Court holden for the Count of Lincoln on Monday the fifteenth day of January 1822 This day the consideration of the last will and Testament of George Dooley deceased was returned and Sundry other persons were sworn and examined touching the competancy of the said George Dooley to make and publish his last will and Testament and the arguments of counsel as wells as the part of the Executors named in the last will and Testament of the said George Dooley deceased as on the part of Thomas Bibb and Betsy his wife (who appeared and contested the validity of the said will) was also heard upon consideration where of it is considered that the said will and codicil are good and valid wherefore it is ordered that the said will and Codicils be recorded. Whereupon on the motion of Peter Carter and Beckham Kelly two of the Executors named in the last will and Testament of the said decedent who made oath as the law directs, and executed and acknowledged bond in the penalty of six thousand dollars with Samuel Craig and Alfred Mucker their securities with a proper condition ordered that a Certificate of the probate of the said will and Codicils be granted them in one form of Law. Samuel Craig one of the Executors named in the said will came into Court and informed the Court that he ______ joining with the other Executors in obtaining a Certificate of the probate of the said will. And from which Judgement and proceedings of the Court in adjudging the said Will and codicil of George Dooley deceased to be good and valid in Law and admitting the same to records the said Thomas Bibb and Betsy his wife posted an appeal to the court of Appeals which is granted to them upon the said Thomas Bibbs executing an Apeal (sic) bond payable to the said Peter Carter and Beckham Kelly the Executors of the said George Dooley deceased in the penalty of five hundred dollars with George Robertson John Edward and Alfred Mocker his security while bond may be executed in the Clerks office of this court at any time within thirty days.
