Lacy celacy@aol.com Date: 11 Aug 2002 Will of John Mills I John Mills Sr., being of sound mind and disposing memory knowing the uncertainty of life, of make and ordain this my last will and testament. 1st It is my desire that my body have Christian burial and that all just debts be paid. 2nd I will and devise to my four infant children Victoria Mills, Gabriella Mills, Joseph Mills and Augusta Mills, the tract of land on which I now reside, containing by estimate one hundred sixty acres. I also bequeath and give to my said four children all of my personal estate, consisting of household and kitchen furniture, farming utensils, stock of cattle, hogs, sheep and horse. In short I will bequeath and devise to my said children the entire estate owned by me at my death, my reason for this disposing of my property is that they are all infants and must have education care and attention in raising and because I have heretofore given to my other children a full and just proportion of the estate I have owned and held, and in some instances I have given more than I will be able to leave my four above named infant children, my other children are now all of age, and provided for and doing well, whilst the four infants are yet to be raised and educated as above stated. 3rd It is further my wish that the aunt of my infant children Victoria, Gabriella, Joseph, and Augusta to wit: Miss Kitty J. Adams have the care and custody of my said children, that they and their said aunt remain and live on my farm where I now reside until said children are grown or married or until the said Kitty J. Adams dies, and that she superintend their raising and education and for this service on her part, I will and bequeath to her the sum of five hundred dollars to be paid out of my personal estate or crops and produce that may be raised on said farm, but to be paid if necessary from said produce thus raised, so as not to interfere with the support and education of my said children. 4th I hereby appoint my friend Dr. George H. Hutchings my executor, and also Guardian for my children Victoria, Gabriella, Joseph, and Augusta whilst their care and custody must remain with their aunt for the purpose aforesaid. Rhea State of Kentucky, County of Logan At a county court held for Logan County at the courthouse in Russellville, KY on the 24th day of March 1879 the foregoing instrument of writing purporting to be the last will and testament of John Mill, Sr., dec'd was produced in open court and ordered to lie over ___ the next register term of said court for probate with summons against J.W. Wooten, T.A. Frazer, and A.G Rhea, the subscribing witnesses thereto, and the same was again produced in open court on the 28th day of April 1879, and proven by the oaths of A.G. Rhea, and J.W. Wooten to be the act and deed, and last will and testament of said John Mills, Sr, dec'd. Whereupon the court ordered the same to be recorded as the true last will and testament of said decedent, which together with this certificate hath been duly recorded in my office.
