WILLS - SMALL, John, Logan County, Kentucky Date: 21 January 2002 From: Jim Small jsmall@mounet.com Will of John Small Logan County Kentucky September 17, 1840 Be it remembered that I, John Small, of the county of Logan, state of Ky, being weak in body, of sound and perfect mind and memory, blessed be Almighty God for the same, do make and publish this my last will and testament in the manner and form following, that is to say: First, I commend and resign my body to God who gave it and my soul to Jesus who hath redeemed and cleansed me from all sin. After my demise, I wish my body to be decently buried and my funeral expenses and all of my just debts to be paid. Second, I give and bequeath unto my beloved wife Winnifred E. Small my negro man David, my barouche and horse, Sam, one good bed stead, and furniture for the same. I do give and bequeath unto my sons Braxton Small, Joseph Small, Spencer Small, and Amanda M. Bailey the sum of three hundred dollars each, which several sums are to make things equal with my other four sons, viz: Fielding Small, James Small, David Small, and Sidney Small, which said several legacies or sums of money I will and order shall be paid to the aforesaid [illegible] legatees within nine months after my decease. I further will and empower my executors to convey and make title deeds to all and any lands that I have given to Sidney Small and Spencer Small, and I will and order that all of my land on which now live, together with a small tract or parcel of land lying on the waters of Clay Lick Branch, all laying and being in the county of Logan and state of KY, shall after my decease be sold on such credits as my executors and children shall think most advantageous to their interest. And I further will and order that my executors shall sell all of slaves not herein disposed of after my decease. And I further will and decree that my executors shall and are hereby empowered to convey and make deeds and bills of sale to all property by them sold. I further order and will that after my decease, that my executors shall sell all of my goods and chatels not herein disposed of on a reasonable credit, and further I will that after all of debts and several legacies herein given are paid that the balance shall be equally divided between all of my children. And lastly, I will and appoint my sons Fielding Small and James Small my executors of this my last will and testament, hereby revoking all former wills by me made.
