YOUNG, his wife Fanny YOUNG, M. P. MOLLOY, his wife M. A. MOLLOY, of Lyon County, Kentucky to J. E. BIRD of same county and state for $450 to be paid in the following sums and the parties named viz. To Z.T. YOUNG $94.68 one year from date, $94.68 two years from date, and $94.68 three years from date, to M. P. MOLLOY $55.32 one year from date, $55.32 two years from date, and $55.32 three years from date. Notes are given for said sums due as stated and each bearing 6% interest from date, ... to secure the defined payments a lien is hereby retained upon the property. a certain tract of land lying on waters of Skinframe Creek in Lyon County, Kentucky and bounded as follows: beginning at a hickory standing at mouth of a lane thence south 192 4/5 poles to a stake with pointers thence north 159 poles to a young black oak corner to John W. CLARK, thence with his line N 83 W 25 poles to a stake his corner, thence N 7 W 20 poles to a water oak near a pond with a triple sweet gum as pointers thence S 4o ½ W 43 poles to a stake thence N 49 W 64 poles to the beginning containing 111 acres more or less. This tract of land was conveyed first parties Nov.15, l89~ by L. R. MOORE and wife (See Record deed, pages 386, Deed Book J) On Sept.24, 1892 first parties sold and conveyed above described tract of land to Jno. W. CLARK, deed never recorded, CLARK having failed to pay any part of the purchase price agreed on Jan.28, 1898 reconveyed to YOUNG and MOLLOY said land for the surrender of his notes given for purchase money which latter deed is also unrecorded both of said unrecorded deeds are in possession of MOLLOY and YOUNG and are delivered to BIRD it is though to be unnecessary to record these two intermediate deeds. It especially provided that if BIRD should fail in any one of his payments that such failure should operate to rnature the whole of his debt, that suit on other proceeding to enforce collection of all notes then outstanding shall lie and right of action be held to have then accrued in favor of the holders of said papers....
