DEED: Peter Lee, 1812, Madison Co., KY -------------------------------- Date: Wed, 21 Oct 1998 From: jimcarp@oneworld.owt.com (Martina Carpenter) -------------------------------- Land Transaction Peter Lee Madison County, Kentucky Deed Book I 1812-1814 Pages 45-48 FHC Film # 0183288 This Indenture made this fifth day of May in the year of our Lord Christ one thousand eight hundred and twelve between Elijah Hendron of the County of Madison and commonwealth of Kentucky of the one part and Peter Lee of the county and commonwealth aforesaid of the other part. Witnesseth that the said Elijah Hernden for and in consideration of the sum of one Dollar to him in hand paid the receipt whereof he does hereby acknowledge & for the further consideration herein after expressed hath granted, bargained and sold and by these presence doth grant, bargain and sell unto the said Peter Lee his heirs and asigns forever a certain tract or parcel of land containing by survey Fifty acres be (?) the same more or less situate lying and being in the county aforesaid by the waters of Silver Creek and bounded as follows, To wit, Beginning at two Sugar trees the northwest corner of George Smith's Survey of Eleven hundred acres on Taylor's fork from thence South twenty degrees west Smith's and Briant's line Eighty four poles to a white oak in solid lines from thence south seventy degrees East ninety six poles to two Lynn (?) trees and a Branch from thence north twenty degrees Eighty four poles to two Buckeye trees in Smith's line and with his line north Seventh six degrees west ninety six poles to the Beginning with its appurtenances to him the said Peter Lee to heirs and asigns forever to have and to hold the same Fifty acres of Land and all and every of its rights immunities or hereditaments thereto in any wise belonging to him the said Peter Lee and unto his heirs and asigns forever and the said Elijah Hendron for himself and his heirs and does and will warrant and forever defend the title of the aforesaid Fifty acres of Land with its appurtenances against the claim or claims of all and every person and persons whatsoever unto the said Peter Lee his heirs and asigns forever. Upon these express trusts and conditions nevertheless that whereas the said Elijah Hendron is indebted to the said Peter Lee in the just and full sum of one hundred and fifty four Dollars current money of the commonwealth aforesaid for which the said Elijah Hendron has this day above written executed his note to the said Peter lee payable the first day of March next and whereas the said Peter Lee has agreed to enter Security for said Elijah Hendron in two notes to Loverow (?) Evans amounting together to the sum of twenty six dollars now if the said Elijah Hendron shall well and truly pay to the said Peter Lee the aforesaid sum of one hundred and Fifty four dollars on or before the first day of March next and shall well and truly pay to the aforesaid Lawerance Evans the amount of twenty six Dollars if the said Peter Lee shall Enter Security for the same, then and in that case this and every provision thereof to be said ___ of none (?) effect but on the contrary if the said Elijah Hendron should fail to pay to the said Peter Lee the aforesaid sum of one hundred fifty four dollars on or before the first day of March next or if he should fail to pay the aforesaid sum of twenty six dollars to Lawerance Evans so that the said Peter Lee should become liable thereupon then and in that case it shall be lawful for the said Peter Lee his heirs or representatives to expose to public the above described tract or parcel of Land of fifty acres to the highest bidder for ready money on the premises aforesaid having given thirty days given previous notice of said sale advertisement in some authorised newspaper in this commonwealth and also by advertisement for the aforesaid space of time put up in writing on the front door of the court house of the county aforesaid and out of the proceeds of said Sale to pay himself the said Peter Lee the aforesaid sum of one hundred and fifth four Dollars together with the interest which may then have accrued and to pay the aforesaid sum of twenty six dollars to the said Lawerance Evans if the said Hendron shall not have before that time paid the same together with the costs of sale and the said Peter Lee is hereby authorised and impowered after having sold the above described tract of Land of fifty acres agreeable to the terms ass to convey the same to the purchaser thereof by and in fee simple. In Testimony whereof of all and singular the premises aforesaid the said Elijah Hendren does hereunto set his hand and seal this day and year first above written. Elijah Hendren S.S.
