Witnesseth that the said Thomas Lee for and in consideration of the Sum of Seventy pounds ten shillings lawful money of the State aforesaid to him in hand paid the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents do grant bargain and sell unto the said Ebenezar Titus his heirs and assigns forever one certain tract or parcel of land situate lying and being in the County of Madison on the waters of Silver Creek and bounded as follows to wit. Beginning at a beech tree on the side of a hill thence South twenty five poles to a white walnut thence North 70 Degrees East 54 poles to a hickory and sugar tree thence South 83 degrees East 58 poles to a double black walnut tree and a small elm on the line of George Smith Survey of 1000 acres thence with said Smith's line North 20 Degrees East 48 [?] poles to a sugar tree the north west corner of said Smith's line thence North 80 degrees West 160 poles to an elm on a Small [?] branch thence down the branch with the meander to a white walnut tree thence South 80 degrees East 5 poles to the Beginning containing 65 acres of land with the appurtenances and premises above mentioned and every part thereof, To Have and to Hold the said tract of land and premises with appurtenances unto the said Ebenezar Titus his heirs and asigns forever and the said Thomas Lee for himself his heirs and asigns the said Tract of land and premises above mentioned against himself his heirs asigns and administrators and against all and every other person or persons whatsoever unto the said Ebenezar Titus his heirs and asigns forever shall and will warrant and forever defend the said land and premises above mentioned.
