I Robert Caldwell of Madison county State of Kentucky do make and ordain this my last will and testament as followeth: 1st I give and bequeath to my friends William R. Setcher and Humphrey Jones Jr. in trust for the sole use and benefit of Amanda my Son Jame's [sic] wife and her children she may have by her present husband, to wit, two Hundred and fifty acres of land off the tract I live on containing three hundred and Seventy one acres, also choice of my negroes, (sic) Jackson excepted, and it is my desire that said Amanda and James her husband have and occupy the land and other premises appertaining thereto hereby bequeathed during their natural lives, and at the decease of Father and mother an equal division be made among their surviving children. 2nd I give and bequeath to the said sureties in trust for the sole use and benefit of Catherine my son David I Caldwell's wife and her children she may have by said David her present husband to wit, One Hundred and twenty one acres of land, the residual of the three hundred and seventy one acres aforesaid after laying off two Hundred and fifty acres to Amanda and her children also one negro girl named Mana and choice of my lots in the town of Richmond and my bank Stock in the Northern Bank of Kentucky, the whole of the bequest to Catherine and her children is to be governed by the same rule, limitation and restrictions as governed the bequest made to Amanda and her children. The balance of my estate both real and personal I give and bequeath to my two daughters Mary wife of James Simpson and Eliza wife of O H Browning to be equally divided between them. But if Eliza dies without issue her part shall be divided amongst the rest of my children. I do hereby appoint my Son in law James Simpson and my Son James Executors of this my last will and testament. Witness my hand signed this 21day of June 1844 R Caldwell Kentucky, Madison County I Jn Shackelford clerk of the County Court of said county, as certify, that a County Court held for said County on the 5th day of June 1848, this instrument of writing was found purporting to be the last will and testament of Robert Caldwell, deceased was produced in open court and there being no subscribing witnesses thereto Joseph Turner (?) and and (sic) Cary A Hawkins were sworn (2 words crossed out or smeared) and interrogated, who proved that the hand writing of said instrument and the signature thereto were in the proper hand unto the said Robert Caldwell decd. And that he was at the date of the Same of sound and disposing mind and memory. Upon which proof it was ordered that said instrument be admitted to second as the true last will and testament of the said Robert Caldwell decd.
