The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ******************* Madison County Will Book I (not one) pp. 47-49 I Martha White being mindful of the uncertainty of life do by these presents {sic} make and publish this my last will and testimony. 1st I will and bequeath my daughter Sallie White my bay mare and her colts, and if the said mare dies and leaves no colts then I wish her to have one hundred dollars instead of the mare and her colts also my set of China ware the gilt set together with twelve teaspoons and Six table Spoons all Silver the new set of table spoons also two cows and the family Bible my bed the one I use myself and beding {sic} for the same and Stead. 2nd I will and bequeath to my grandson Jacob Samuel White one bed the same the one allotted to me now standing up stairs. 3rd I will and bequeath to my three daughters Amanda Caldwell Sally White and Elizabeth H. Cole all the spun yarn and thread carpet yarn and carpeting belonging to me to be divided equally between them. 4th I will and bequeath to my grandson Robert Caldwell the family Clock because it was his grandfather Caldwells In addition to those things given to my daughter Sally White in Art. 1st I wish her to have the cooking Stove and vessells {sic} June 22, 1868 Martha White Teste. E.B. Crockett S. W. Crutcher (Codicil) I Martha White being old and infirm in body but of Sound and disposing mind and memory and having a full knowledge of my property and a fixed purpose of disposing of the same and having heretofore Made and published my last will is now in the hands of my friends Samuel Crutcher and out of my Control I wish to add the following Codicil to the said will. I will and wish that any and all of my children or grand children that have disposed of or that may dispose of or sell their interest or interests in the dower estate of my late husband Jacob S. White Sr. during my life time may be excluded from inheriting any part of my property and I do by this presents will and wish that my property Whatever it may be shall be divided amongst those of my children and grand children that have not so sold or disposed of their interest in said dower estate according to their legal rights. I further will and wish and do hereby appoint John G. Cole the executor of my last will and testament and this codicil having full faith that he will faithfully carry out the provisions of my will & speedily Settle up and distribute my estate amongst my heirs except those hereby excluded. I also give him full power to act as my executor without requiring bond or Security as such and do not wish him to be required to give either bond or Security as my executor given under my hand this the tenth day of September 1870 and made and published this day and date above as stated. Decd. and the will was proven by the oath of E. B. Crockett Subscribing Witness thereto who also proved the attestation of S.W. Crutcher the other witness thereto and the Codicil was proved by the oath of Dudley Tribble Jr. who proved the attestation of the other subscribing witness thereto. Whereupon the same was allowed and established as the last true will and testament of the said Martha White dec & ordered to be recorded as such & the same has been done accordingly.
