All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ky/kyfiles.html ************************************************ File contributed for use in USGenWeb Archives by: Michelle Woodham mw4au@aol.com September 9, 2009, 11:08 am Source: Madison County, Kentucky Wills Book J Pp.262-263 Lds Film#183270 Written: January 11, 1849 Recorded: February 4, 1850 I Humphrey Tunstall of Madison County do hereby make my last will and testament in manner and form following that is to say: 1st I desire that all the perishable part of my estate be immediately sold after my decease and out of the money arising therefrom all my just debts and funeral expenses be paid. 2nd I give to Humphrey T Hill son of Harrison Hill and Patsey his wife all of my lands in Madison County lying on the waters of Station Camp creek the same I live on to him and his heirs forever. 3d I emancipate and set free my several negroes here named, Say, Squire, Jack, Henry, Harvey, Sin, Bot, and Sara, provided they give the Madison County court good and sufficient security for their maintenance and good behaviour and if they should fail to comply with the above requisitions I give them all to Humphrey T Hill son of Harrison and Patsey Hill as slaves for life. 4th It is my will and desire after my death that my several negroes named Say, Celia, Harrison, Green, William, Miranda, Mary, Janor & Merica all Celia's children be sold to the highest bidder by my Executors and the proceeds to be equally divided amongst the infant heirs of Harrison and Patsey Hill at the time of my death. 5th I give to John W Parkes and Silas Newland two hundred dollars each out of the proceeds of my estate. 6th All the rest of my estate both real and personal of whatever nature or kind soever It may be not herein before particulary disposed of I desire may be equally divided amongst the heirs of Harrison Hill and Patsey his wife that is to say, what heirs they may have at the time of my death. And lastly I do hereby constitute and appoint my friends John W Parkes and Silas Newland Executors of this my last will and testament hereby revoking all other or former wills or testaments by me heretofore made. In witness whereof I have hereunto set my hand affixed my seal this 11th day of Jany 1849. I J.M. Shackelford clerk of the County court of said County, do certify that at a County Court held for said County on the 4th day of February 1850 this instrument of writing was produced in open court, and proven to be the last will and testament of Humphrey Tunstall decd. by the oaths of William Kindred and John Sam subscribing witnesses thereto, and ordered to be recorded as such, and the same has been done accordingly.
