West of the County of Lewis and State aforesaid of the other part. Witnesseth that the said George Clark and Nancy his wife for and in consideration of the sum of Two Hundred dollars to there in hand paid by the said Eli Vaughn & Samuel C West, the receipt whereof is hereby acknowledged they the said Georg Clark & Nancy his wife, have given, granted, bargained, sold and confirmed and do by these percents give grant bargain sell confirm & convey unto them the said parties of the second part, their Heirs and assigns Track or parcel of Land lying and being in the County of Lewis and State of Kentucky and on the waters of the East fork of Cabin Creek and bounded as follows to wit; Beginning at two Sugar & Buckeye trees corner to Wm. Jacks Thence N 52 poles to a White Oak on the Creek Thence up the Creek with the Meanders Thereof N 68o E 32 poles N 26o E 92 poles to a Buckeye standing on the creek thence S 48 poles to three ? In a bunch. Thence to the beginning containing Thirty acres of Land being the same trace of parcel of Land conveyed to the said George Clark and Nancy Clark by William Viers by Deed bearing date the last day of May 1822 and duly recorded in Deed Book D Page 153. To have and to hold the before described tract of Land together with all and ? the improvements and appertenances thereunto belonging or in any wise appertaining to their ?? and Eli Vaughn & Samuel C West their heirs and assigns forever to their only proper use, benefit and behoof forever and the said George Clark & Nancy his wife for themselves, their Heirs Executor or Administrators do hereby covenant ? Unto and with the said Eli Vaughn & Samuel C West their Heirs and assigns the aforesaid Tract or parcel of Land and appertenances unto them the said Eli Vaughn & Samuel C West their heirs and assigns Doth and will forever warrant and defend by these presents from and against the claim or claims of all and every person or persons claiming or to claim the same by through or under them the said George Clark & Nancy his wife or their heirs and assigns and from no other person or persons whatsoever. In witness whereof the said George Clark & Nancy his wife, have hereunto set their hand and seals the date above written. his Attest George X Clark O.P. Tammian (questionable) Mark Nancy Clark On the left hand side of the docket in which the above deed was entered is the following notation: George Clark & wife ** Deed**Eli Vaughn & Samuel C West * Fee paid * Examined MM (No 31) and written down the side of the document is the date, Nov. 21, 1859 and the Deputy Clerk's signature which looks to be O.P. Tammian. A copy of the Deed can be found in Deed Book L, Pages 33-34, Lewis County Clerk, Vanceburg, Kentucky 41179. NOTE This deed is extremely old and the copy sent to me from the Clerk's Office in Lewis County, Kentucky was very difficult to read. I have transcribed the best I could under the circumstances. Spelling I have kept as was in the deed, but have added some punctuation to make reading a little less difficult. The following Deed can be found in Deed Book "D" pages 153-54-55 at Lewis County Clerk's Office, Vanceburg, Kentucky 41179 and reads as follows: Wm M. Veirs To Deed Geo. Clark Tax Paid. Examined THIS INDENTURE made and Entered into this 1st day of May 1822 Between William M. Veirs of Garrard County and State of Kentucky of the one part and George Clark and Nancy his wife of Lewis County and State aforesaid of the other part. Witnesseth that the said William M. Veirs for and in Consideration of the Sum of Sixty Dollars; To him in hand paid by the said Clark and Nancy his wife, at and before the Signing, Sealing and Delivery of these Presents the Receipt of which is hereby a knowledged, Hath given, granted, Bargained, Sold, Aligned and Confirmed unto the said George Clark and Nancy his wife the Heirs and assigns forever the following Piece or Parcel of Land Situate in Lewis County, and on the East fork of Cabin Creek and Bounded as follows- Beginning at two Sugar and Buckeye trees Corner to W Jack (This name is shortened in the old English style so the first name could be William, Wilson et. And the last name is Jacks or possibly Jackson). Thence North 52 poles to a white Oak on the Creek; Thence up the Creek Creed with the Meander thereof N 68 E 32 poles. N 26 E 92 poles To a Buckeye Standing on the Creek. Thence South 48 poles Then South 35 E 48 poles to Three? In a Bunch Then to the Beginning containing Thirty Acres of Land. Together with all and Singular the profits ? Rents and advantages therewith belonging or in anywise appertaining To have and to hold while the said George Clark and Nancy his wife their Executors Administrators and assigns forever, and to their and their only proper use benefit and behoof doth the said William Veirs for himself his Heirs, Executors and Administrators doth hereby covenant and agree to and with the said George Clark and Nancy his wife. Their Heirs and assigns that the Premises hereby intended to be conveyed now are and forever hereafter shall remain free of and from all former And other gifts, grants, Bargains, Sales, Covenants, Dowers Right and Title of Dower and all, and every other Incumbrance. Whatsoever done or Suffered to be done by him the said William M. Veirs unto the said George Clark and Nancy his His wife their Heirs and assigns forever. And that the Premises aforesaid, he the said Veirs his Heirs and assigns will warrant and forever defend against the claim of himself and all and every other Person or Persons whatsoever claiming or to claim by through or under him-IN TESTIMONY whereof the said William M. Joseph Rob, Clerk of the Count for the County aforesaid, do Certify that the foregoing Deed from William Veirs to George Clark was this day produced before me and duly acknowledged by the said Veirs, to be his act and Deed for the purpose therein mentioned, And the Same with this Certificate is Recorded in my office given under my hand the first day of May 1822. J.J. Robb Clk On the side of page 153 of the above deed is written "Delivered to George Clark the 21st day of September 1822 and signed by Robb Clk. Personal Note: The aforementioned document has been copied exactly as worded. Some punctuation has been added for convenience in reading said document. (A copy is in my possession.) The Clerk, Mr. Robb signed his name with such a flourish that his initials are undistinguishable.
