Grisby of the same County one small mare and a light two horse wagon for the sum of one dollar to me in hand paid and the further consideration herein after expended to have and to hold the said mare and wagon unto him said Samuel Grisby his heirs ----? And the said Benjamin Morgan for himself, his heirs, and the above described property free from the claim or claims of all persons unto the said Samuel H. Grisby his heirs & atte? and will forever warrant and defend by these presents. Nevertheless it is understood between the parties hereto that the above conveyance is in consideration of said Grisby having ----? security for said Morgan on a note executed by him to Heri? Literworth? for twenty five dollars and is to indemify and --? harmless said Grisby from any loss or damage he may sustain by having to pay the said note or any part thereof now therefore if said Morgan or any one for him faithfully and properly discharge and pays off said note when the same falls due then this deed of conveyance to be null and void else to remain in full force and virtue in law and equity. I Braxton Small Clerk of the County Court for the County aforesaid do certify that this mortage from Benjamin Morgan to Samuel H. Grisby was on this 31st day of January 1852 acknowledged before me in my office by the said Morgan to be his act and deed and immediatly placed on the index for record.
