Submitted by: Vera Burnham Date: June 21, 2002 **************************************************************************** Will Book A McCracken County, Kentucky Page 78 In the name of God Amen I John Smedley ? of the County of McCracken and State of Kentucky, being weak in body but of sound mind and disposing memory, do make constitute and ordain this my last will and testament, hereby revoking all wills and testaments by me heretofore made Item 1, I wish all my just debts paid, and for that purpose I wish my executor hereafter named to sell so much of my personal property as will ----? to pay the same Item 2, I do hereby give and bequeath to my beloved wife Susan and my beloved children, Augusta, Maria, Louisa, John C. and Ann Smedly ? all of my property both real and personal after all my debts are paid. My wife Susan to hold the property in her possesion with my above named children during her widowhood and until they shall arrive at the age of twenty-one years or marries Item 3, If my wife Susan should marry then I wish my property to be equally divided amongst my children whether they have arrived at the age of twenty-one or not, And my wife to take so much as one of my children would or an equal ----? intitled to during her natural life and after her death ---? and be equally divided among all my above named children or their heirs. Item 4, I wish all my children as they arrive at lawful age to receive their equal proportion of my estate. Item 5, I hereby authorize and empower my executors to ---? their interest which Joseph C. Gaystock ? deceased was entitled to ----? house in the town of Paducah wherein myself and J. Garstock and I ----? parting. Item 6,I wish my executor to sell at retail or wholesale whichever they shall deem best, all my goods and chattles now in my possession with the exception hereafter mentioned or which may hereafter come in this possession for me, and all the goods and chattles which I am entitled to see as surviving partner of the late given ? of J. Garstock Item 7, I wish my executor after all my debts are paid if there be any money on hand to vest it in real estate or to loan it out taking good sufficent security by mortgage on real estate to secure the payment of it whenever demanded by them. Item 8 I wish my household furniture of every discription & kind not be sold but to remain for the benefit of my wife and my children Item 9, I do hereby constitute and appoint my father Christian Smedly, my brother, Hiram Smedley and my freind Robert Fletcher my sole executors of this my last will and testament resting them with full and ample authority to carry the same into effect,they giving bond and security according to law Sept.25,1835 John Smedley ?
