WILL: Colter, John, 1810 - Mercer County, Kentucky --------------------------------------------------------------------------- Transcribed by: Pam Carey Durstock "durp@one.net" April 09, 1999 ------------------ I was at the courthouse on Wednesday, and don't ask me why (I'm not a Coulter descendant) ... but for some reason I photocopied John Coulter's will. Here it is (mis-spellings are as found in the document [I hope ]): --------------------------------------------------------------------------- In the name of God amen I John Colter of the County of Mercer & State of Kentucky being in a low state of health though in Sound mind and memory, do make this my will and testament as followeths ?Imprimus? at to my worly Estate I give to my dear & loving wife for tarm of life or widow[hood] the house wherein I now dwell together with two thirds of all the proptate arising from my [word scratched out - looks like 'farm'] forward or otherwise to remain togather with my Nagrow by Peetor that I will to Stay on my farm, and two thirds of the banefits of his labours on the tarms as above also the wild aire mare two work horses on third of the Stock of Cows hogs & sheep the Cupbord and its furniture one beadstod bead and furniture and on her desees or marige to be Equelly divided bewisct Thomas John Anne Dalithy and Starling Colter. Item I give to my son Charles Colter togather with what he hath hertofore ?cuewd? five pounds in cash. Item I give to my son Thomas Colter the Land whereon he now lives as runout at the price and out of his part one hundred and seven pounds ten shillings one horse thirty pounds one bed and furniture and tan pounds one cow three pounds one plow a nasc? & two pounds on Chest Eighteen Shillings all in his possession. Item I gave to my son John Colter the land he lives on as runout at the price of his part of any estate one hundred and seven pounds ten shillings on horse at thirty pounds one cow at three pounds one ass & chest one pound siscteen shillings. Item I give to my daughter Anne Colter one mare at thirty pounds a bed & furniture at tan pounds one Beauroi? five pounds fiftheen shillings. Item I will that Delothy Colter my daughter that hath not yet receiv'd anything be made Equel to the other Lagetees. Item I give and bequeath to my son Starling Colter the land on which I now live to Include the land Bought of Abenasor Blackstone and a line from the northwest corner of the same unto the northwast corner of the survey I live on at the prese of one hundred and saven pounds tan shillings and three umainding one third of the prophet arising from the farm and the labour of theis aforesaid boy for the purpose of his scooling and raising. All the rasidue of my good and chattles of Every kind I order and will to be sold and the money togather therewith tho Lagesess as the stand Charge to be so divided as to make all the five youngest Equal it being my will tha the alone should heir the same and that the same me Join to a fact I substitute and appoint as my Execturos my beloved sons Thomas Colter & John Colter which I also charge with the payment of my sd legacees. In witness whereas I have hereunto set my hand and seal this 19 Day of May and in the year of the Lord 1809. Sealed publeshed and declared by the above named John Colter for and as his last will and testament and in presence of us John Colter [seal] John Henderson William MGinnis Samuel Hocker Mercer County Pct December County Court 1810. The foregoing Instrument of writing was produced into Court and proved to be the last Will & Testament of John Colter Deceased by the Oaths of Samuel Cocker and John Henderson two subscribing witnesses thereto and Ordered to be recorded.
