The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************* Will: Edward Darnaby, 1819, Mercer County, Kentucky In the name of God Amen, I Edward Darnaby of the County of Mercer and Commonwealth of Kentucky being of sound mind & judgment, do hereby dispose of all my property both real and personal in the following manner, Viz., 1st I wish all my just debts punctually paid. 2nd I bequeath unto my wife Elizabeth Darnaby, one hundred and Seventy five acres of land, on which I now live, be the same more or less and where Stephen Munday now lives be the same with all the appurtenances, also I give and bequeath unto my said wife Elizabeth Darnaby, Eight Negroes namely: Cambridge, Richmond, & Penny with her five Children, Stepnny, Tom, Wilks, Burton and Louis, Also I give and bequeath unto my said wife Elizabeth Darnaby, as many of the stock of Horses, Cattle, Sheep & Hogs, of the Household & Kitchen Furniture and Farming utensils, as she in her judgment may deem necessary for her use & comfort during her natural life. It is my will then that after such reserve be made by my wife the said Elizabeth Darnaby, that the residue of said Property if there be any be sold at twelve months Credit, and the money arising therefrom, be equally divided among the Legatees, herein hereafter named. Item I give and bequeath unto my Daughter Lucy Thomas five Dollars, unto her four Children, Fielding, Mahala, Eliza and Lucinda, three Negroes, Viz.; Tamar, and her two youngest Children, Matilda & Phebe, but provided my Daughter Lucy Thomas, should become a widow or be legally divorced from her husband, Joseph Thomas, it is my will she shall have the entire use & comfort of said Negroes, during her natural life or widowhood, and at her death for the said Negroes to go to her four Children above mentioned, namely, Fielding, Mahala, Eliza & Lucinda, them and their increase forever. Item I give unto my daughter Nancy Pugh, two Negroes, Viz.; Sam & America whom she has now in possession, also one Bay mare and Colt, them and their increase to her and her Children forever. Item I give unto my Daughter Elizabeth Poge (Poague), one Negro Woman named Eady and her four Children, namely Moriah, Toby, Caroline and Queen whom she now has in possession, also one Sorrel mare & Colt them and their increase to her and her Children forever. Item I give and bequeath unto my Daughter Susannah Munday, five Dollars, but unto her four Children, Elizabeth, Sandford, Julianna, Talefero, also one infant without a name, (Valentine S.) three Negroes Viz.; Delila and her youngest Child, Eleanor, with a boy named James, but should my said Daughter Susannah Munday become a Widow it is my will that the said Negroes last mentioned should become hers during her natural life or widowhood, and at her death for the said Negroes to go to her Childre, them and their increase forever. Item I give and bequeath unto my Son Cornelius Darnaby, One hundred acres of Land, the same being the land which he sold to Martha Furguson, and on which she now lives. Also one Negro boy named Claburn whom he now has in possession, also one Stud Colt to him and his heirs forever. But should my son Cornelius Darnaby endeavor to obtain more of my Estate than is herein specified he shall not be entitled to one farthing more than is herein specially named for him, otherwise, he shall be entitled to an Equal share of the Residue of Property with my other Children. Item I give unto my Daughter Averilla Gordon tow Negroes Viz.; Zachariah & Crecy and one bay mare to her and her Children, them and their increase forever. Item I give and bequeath unto my Daughter Sally Massie, two Negroes Viz.; Wiatt and Lucy, whom she now has in possession, though should my Daughter Sally Massie die without lawful heir begotten of her body, then what I have left her shall be Equally divided amongst the ther Legatees. After the decease of my wife Elizabeth Darnaby, it is my will that the land left her during her natural life, be sold at twelve months Credit, and the money arising therefrom equally divided among my Children heretofore named, reserving the Equal part of my Daughters Lucy Thomas and Susannah Munday, to be equally divided amongst their children as heretofore named. It is likewise my will & desire that the Residue of the Property be in like manner sold and the money arising there from equally divided as above. I now do hereby appoint my wife Elizabeth Darnaby, Cornelius Darnaby, William Gordon, and Barnard Noel witness of this my last will and testament revoking all others. Redd Benj'd Daniel X Bernard Noel X William Long X Codicil I Edward Darnaby of the County & State within mentioned, have deemed it my duty to liberate my Servant Cambridge, for important services. For a service or years rendered me by said Servant, It is therefore my will that at the death of my wife Elizabeth Darnaby, he be set free, & no longer than that serve under bondage or in slavery to any person or persons. It is further my will that at the time of his ______ , he shall have my Grey Brood mare, or the value thereof, and this freedom of said Cambridge my En's will have ___ agreeably to the legal form of the commonwealth.
