After the payment of my Just and Lawful debts I will that my Estate be disposed of in the following manner. I give to my Son James H. McGinnis my Silver watch, I give to Jesse McGinnis son of James H. McGinnis 25$ to purchase him a colt. I give to my two Sons Benjamin L. McGinnis and Jesse S. McGinnis the tract of land whereon I now reside containing 157-3/4 acres to be equally divided between them and their heirs forever and if either of them Should die without lawful issue then the whole of it is to go to the Survivor and if them Should die without lawful issue then it is to be Sold and the proceeds be divided equally amongst my other Children that may be living and the Children of those that may be dead all the Children of one dead Child taking one Share. I give to my Son J. B. McGinnis the tract of land I purchased of the Executors of John Henderson Dec'd containing 43-3/4 acres at valuation provided he is willing take it in that way as part of the whole of his part of my Estate. I desire that the balance of my estate be Sold and the nett proceeds thereof be equally divided among all my Children or their decendants as the case may be except Benjamin L. McGinnis and Jesse S. McGinnis they are to have Benjamin L. McGinnis 150$ and Jesse S. McGinnis 250$ and no more of the proceeds thereof. The estate herein given to the Children of my deceased Daughter Patsy McGinnis is to be paid to them principal and interest as they come of age the younger child Patsy is to have two Shares and the balance to be equally amongst the other Children. It is my desire that the estate herein left to my daughter Peggy be paid to her provided her husband will bind himself to refund Sd. Estate without Interest at her death and in case of his refusal to do So, then it is my will and desire that my Executors Shall detain the Same in their hands paying her the interest thereof half yearly during her life and at her death divide the Same amongst my living Children and the decendants of those that may be dead the Children of of each of those that may be dead receiving all together in one Share. It is my desire that the Estate herein left to my daughter Agnes be detained by my Ex'rs and the interest only be paid to her half yearly during the life of her husband and at his death She to receive the whole with the interest that may be due. It is my desire that the Estate herein given to my Daughter Sally be detained by my Ex'rs and that they pay her half yearly the interest thereof during the life of her husband and at this death it is my desire that the sd. Estate be paid to her. If her husband should be the Survivor it is my desire that the interest of her part of my Estate be laid out by my Ex'rs for the clothing and Schooling of her children. It is my desire that the Estate herein given to my daughter Nancy Mormon dec'd late Nancy McGinnis be detained in the hands of my Ex'rs and that the interest thereof be laid out by them for the benefit of her decendants until they become of full age at which time each one as he or She may become of age Shall receive his or her part of Sd. Estate. It is my desire that in the Sale of my Estate as aforesaid that George and Louisa two of my Slaves Shall not be Separated or Sold out of the family unless they are willing. I hereby nominate, constitute and appoint my sons James H. McGinnis, William R. McGinnis and John B. McGinnis the Executors of this my last will and Testament. Rains Boyle County Court, May Term 1843 This paper purporting to be the last will and Testament of Jesse McGinnis deceased was exhibited in Court and proved by the oath of John A. Burton a Subscribing witness thereto and the hand writing of Charles F. Burton deceased another Subscribing witness thereto was proved by the oaths of James P. Mitchell, Jesse W. Burton and J. A.
