Deposition of John B HESTAND, taken same place & time as last posted.

Age, residence, occupation: 46, Monroe Co, farmer.

Are you acquainted with any of the parties in this cace: I know Frank
  EMMERT and Jefferson MOORE, I knew Margaret Emmert when a 
  boy.

How long have you known MOORE? 30-35 years.

Are you acquainted with the land in question? Yes, 25-30 yrs.

How far do you live from the land? 1 1/2 - 2 miles, all my life.

Who was in possession of the land when you first knew it? I think
  Henry WAGGONER.

What disposition did Waggoner make of the land? Didn't know.

How long did Waggoner possess the land? 2-3 yrs.

What happened to the land when Waggoner disposed of it? 
  Jefferson Moore came into possession.

How long did he possess it? Still in possession as far as I know

What acts of ownership & possession has Moore exercised?
  He seems to be in control of it, selling timber off it, I've bought
  lumber from him and he contracted to sell it once to Carry Liz
  WOODS.

How long has Moore been exercising control of the land? 20-25 yrs,
  don't know exactly.

Cross-examination.
Did Moore ever live on the land? I don't think he ever did.

Did he not sell the land to Carrie Liz WOOD once?  He contracted
  to sell it to her.

DId he make her a title to the land? I don't think he did, I think she
  failed to pay for it.

Do you know why she failed to pay? No sir

Was the sale or contract rescinded because he could make no
  title to the land? I don't know about that.

Did you ever buy any timber from C L WOOD off the land?
  Yes sir, I think I did.

Who did you pay? I paid her some of it and some to Jeff Moore.
