Shirley Indenture: David Badger to William Nelson: Montgomery County KY Date: 31 August 1810 Deed Book 5 Page 349 This Indenture made this thirty first day of August, in the year of our Lord one thousand eight hundred and ten, between David Badger and Elizabeth his wife of the County of Montgomery and Commonwealth of Kentucky of the one part and William Nelson of the County and Commonwealth aforesaid of the other part Witnesseth that the said David Badger and Elizabeth his wife in consideration of the sum of one hundred and ninety five Dollars lawful money of the United States to them in hand paid the receipt whereof is hereby acknowledged hath granted bargained and sold to the said William Nelson thirteen acres and a quarter of land in the county of Montgomery and on the waters of Grassy lick and is bounded as follows towit, Beginning at a sugartree and box elder on Farrows line in the bank of the west fork of Grassy lick and extending thence North twenty eight and a half degrees East fifty eight poles to a white thorn tree thence South fifty six degrees East sixty five poles to a stone in the west fork of Grassylick creek thence west running up the said West fork and bindiry thereon the meanders thereof the creek the line eighty four poles to the Beginning. With all its appurtenances. To have and to hold the said parcel of land with the appurtenances to the said William nelson andhis heirs to the only proper use and behoof the said William Nelson and heirs forever and the said David Badger and Elizabeth his wife the said parcel of land with the appertenances unto the said William Nelson his heirs or assigns against the Claim of all persons whatsoer claiming by through or under-them or their heirs doth and will warrant and forever defend provided said land should be lost the said David Badger to refund the purchase money which is one hundred and ninety five Dollars without Interest, In Witness whereof the said David Badger and Elizabeth his wife hath hereunto set their hands and seals affixed their seals this day and Year first above written Signed sealed and delivered David Badger (seal) In presence of Elizabeth Badger (seal) Benjm J Taul Montgomery County Clerks office sct fifth of March eighteen hundred and eleven-This Indenture of bargain and sale from David Badger and was to William nelson was acknowledged by said Badger to be his hand and seal act and deed.
