Shirley Indenture: William F & Phebe Ann Darnall to William Nelson: Montgomery County KY Date: 30 November 1833 Deed Book 16 Page 316, 317 This Indenture made and entered into this 30th day of November 1833 between William T Darnall and Phebe Ann his wife of the county of Bourbon and state of Kentucky of the first part, and William Nelson of the County of Montgomery and State aforesaid of the second part: Witnesseth: That the said William T Darnall and Phebe Ann his wife, for and in Consideration of the sum of Three Hundred Dollars to them in hand paid by the said William Nelson, the receipt whereof they do hereby acknowledge, have this day granted, bargained and sold and do by these presents grant, bargain and sell unto the said William Nelson his heirs and assigns forever, a certain tract or parcel of land lying on the waters of Grassylick creek in the County of Montgomery & state of Kentucky, containing thirty acres and eleven square poles of land, it being the said Phebe Ann's part of the land of her deceased father John Tatman, and is bounded as follows, to wit, Beginning at a Hickory tree corner to William Nelson Sr thence N 56 degrees W 37.87 poles, to a stake, thence N 34 degrees E 80 poles to a stake, thence S 56 degrees E 63 poles to a stake, thence S 5 degrees W 18 poles to a stake, thence S 60 degrees W 727 poles to the Beginning, together with all and singular its appurtenances there unto belonging or in anywise appurtaining , To have and to hold the said tract or parcel of land with all and singular its appurtenances thereunto belonging unto the said William Nelson his heirs and assigns forever, And the said William T Darnall and Phebe Ann his wife doth hereby covenant to and with the said William Nelson that they will forever warrant and defend the said tract or parcel of land unto him the said Nelson his heirs and assigns, against the claim of themselves and all persons claiming by through , or under them, and against the claim of all persons claiming or to claim by through or under John Tatman deceased or his heirs but not against any adverse claims whatever.- In testimony whereof the said William T Darnall and Phebe Ann his wife have hereunto set their hands & affixed their seals to this Indenture this day and year first above written Witness William T Darnall (seal) Geo S Hampton DC Phebe Ann Darnall (seal) Commonwealth of Kentucky Montgomery County: to wit: I Micajah Harrison Clerk of the court for the County aforesaid do certify that the deed from William T Darnall and Phebe Ann Darnall his wife to William Nelson was this day produced to me in my office and acknowledged by the said William T Darnall to be his act and deed, and the said Phebe Ann Darnall being examined by me privily and apart from her husband declared she did freely and willingly seal and deliver the said writing and wishes not to retract it. And acknowledged the said writing again shown and explained o her to be her act and deed and consenteth that the same may be recorded.
