I will gladly attach to email for you any document I have transcribed.srm This Indenture made and entered into by and between, Charles L Stewart and Martha Ann his wife late Martha Ann Fulton Samuel D Roberts and Mary Jane his wife late Mary Jane Fulton, Harriet Fulton, Margarett Auvilla Fulton heirs and Legal representatives of John Fulton Decd By Belvard J Peters a Commissioner appointed by the First Montgomery Circuit Court to convey all the right title and interest of the persons herein named in and to a certain tract or parcel of Land herein after to be more fully described of the first part and William Moore of the County of Montgomery and state of Kentucky of the second part Witnesseth, That whereas heretofore to wit on this day the said Belvard J Peters has been by a Decree of the First Judge of the Montgomery Circuit Court summoned? in the Suit in ?Chancery? now defending in said Montgomery Circuit Court wherein William Moore is complainant and Charles L Stewart and others the heirs of John Fulton Deceased are Defendants appointed by Said Court a Commissioner to convey all the right title and interest of the Said Heirs of John Fulton decd in and to a certain tract of land herein described to Said William Moore, Now for and in consideration of the promises and by virtue to the Said Decree of Said Court the Said party of the first by Belvard J Peters Commissioner as aforesaid doth granted bargained, and sold, and by these presents does grant bargain sell alien convey and confirm with him the Said William Moore all the right title and interest of the Said Charles L Stewart, and Martha Ann Stewart his wife late Martha Ann Fulton, Samuel D Roberts and Mary Jane his wife late Mary Jane Fulton, Harriet Fulton, and Margarett Auvilla Fulton heirs at Law of John Fulton Decd in and to a certain tract or parcel of land Situate lying, and being in the County of Montgomery, on the waters of Aarons Run containing 50 Acres and bounded as follows to wit, Beginning at the Letter A on the Map, a Buckeye, and Sugartree corner to Rogers on Carringtons line, Thence with this line 81 degrees 30 W 72 poles to a stake where two Sugartrees and a coffe nut, formerly Stood corner to Said Carrington and John Wilson at B. Thence S 10 degrees 30' W 33 4/10 poles to a Honey Locust and Elderberry Stumps corner to said Wilson at C. Thence N 61 degrees 45' W 101 4/10 poles to a stake on Said Fultons line at S. Thence with Said Line N 50 4/10 poles to a Stake corner to the School House Lot-Thence East 12 2/10 poles to a stake Thence N 64 1/10 poles to a stake Set Stone corner to Said Rogers, Thence with his line E 87 4/10 poles to the Beginning, To have and to hold the aforesaid tract or parcel Land together with all and singular the premises and appurtenances there unto belonging or in any wise appertaining, unto him the Said William Moore and his heirs forever, And the Said Party of the first part the heirs of John Fulton by B J Peters commissioner as aforesaid will warrant and Defend the title to Said Land unto the Said William Moore and his heirs and assigns forever against themselves their heirs and all persons claiming from by or through them, and they do furthermore covenant and agree to refund the purchase money it being One Thousand Dollars unto the Said William Moore if Said Land Shall ever be lost by any better or Superior claim, the purchase maney to be refunded without interest, And it is furthermore distinctly understood that Belvard J Peters has no interest in this matter further than & to his duty as a commissioner being no party, and is not in any event whatsoever to be responsible personally, on testimony where of the Said party of the first part has here unto Subscribed their hands & seals this _____day of September 1841, Charles L Stewart (seal) Martha Ann Stewart (seal) Samuel D Roberts (seal) Mary Jane Roberts (seal) Harriett Fulton (seal) Margarett Auvilla Fulton (seal) By Belvard J Peters Commissioner (seal) State of Kentucky Montgomery Circuit} Sct. September Term 1841 I James Howard Clerk of the Court for the Circuit aforesaid, do Certify that this Deed from Belvard J Peters the Commisssioner therein named to William Moore was this day produced in open court and acknowledged by the said Belvard J Peters to be his act and deed. as Commissioner aforesaid, Which was received and ordered to be recorded, which is done accordingly, and is hereby certified to the Clerk of the Montgomery County Court to be by him recored, Given under my hand this 11th day of September 1841 James Howard CMCC Commonwealth of Kentucky Montgomery County, to wit} I James Howard Clerk of the County Court for the County aforesaid do certify that this deed from Belvard J Peters the Commissioner therein named to William Moore was this day produced to me in my office for record, whereupon by virtue of the Certificate of the Clerk of the Montgomery Circuit Court on Said Deed enclosed the Said Deed and certificate together with this certificate have been duly admitted of record in my office- Given under my hand this 11th day of September 1841 James Howard clk
