Witnesseth, that whereas by virtue of an assignment made by one Martin Stedham upon a title bond executed by Wm C Shubert, said Marting Stedham bearing date of August 22, 1870, and afterwards assigned by said Stidham to one James Collings January 4, 1875. And Afterwards assigned by James (S. or I.) Collings to James Spears the party of the second part on the 16th day of October 1877. now for and in consideration of the above assignments and the further consideration of one hundred and thirty seven dollars for which the party of the first part has said James Spears note bearing date of October the 16th 1877. Said note is subject to the following credit, to wit; Rec'd on the within note the interest for one year which is $10.37 paid in sheep also paid on the principal $17.24 cents also paid in Sheep this October 15th 1878. Paid on the within note $7.96 with a Calf also 31 cents interest paid on the on the $7.96 cents from Oct 15th 1878 to April 15th 1879. leaving a balance still due on ___ from Oct 16th 1878 of one hundred and twelve dollars. ______ to bear interest at the rate of _ percent per annum until paid for all of which specified considerations the parties of the first part have this day granted, bargained and sold and doth by these presents grant, bargain, sell and convey unto the party of the second part a certain tract or parcel of land situate and being in the county of Montgomery and the State of Kentucky and being known as the Moses Woodard land and being the same land conveyed by by deed from E.E. Garrett as Commisioner to the parties of the first part for a more full description of said land reference is had to a deed from said Garrett as Comm. To the said Wm C. Shubert. Now on record in the Montgomery County Court Clark's office in Deed book 29, page 5, to have and to hold unto the party of the second part his heirs and assignees etc forever from the parties of the first part and their heirs and assigns forever hereby warranting and defending such title as they may possess, from the conveyance made by said Commisioner and from no other. A lien is hereby reserved upon the land until the purchase money is paid. In testimony whereof the party of the first part have hereunto subscribed name and affixed their seals the day and date firstabove written.
