Shirley Indenture: Philip Jr & Sally Hathaway to James Simpson : Montgomery County KY Date: 14 October 1833 Deed Book 16 Page 344 This indenture made this 14th day of October in the year of our Lord One Thousand Eight hundred and Thirty-three between Philip Hathaway Jr and Sally his wife of the County of Montgomery and Commonwealth of Kentucky, on the one part, and James Simpson of the County of Montgomery and Commonwealth aforesaid of the other part, witnesseth, That the said Philip Hathaway and Sally his wife, for and in consideration of the sum of one dollar, current money of Kentucky to them in hand paid, the receipt whereof is hereby acknowledged: have granted, bargained and sold, and by these presents do grant, bargain, sell, and confirm unto the said James Simpson his heirs and assigns: all that tract or parcel of land, situated and being in the County of Montgomery on the waters of Hingston, containing Three and three fourth acres, and bounded as follow. to wit: Beginning at a stake in the great road on Gillaspies line thence S 84 degrees E 73.5 poles to a stake in the great road, thence along the middle of said road N 53 degrees W 27.4 poles to a stake thence N 84 degrees W 23.4 poles to a stake, thence S 64 degrees W 22.8 poles to a stake, thence S 81 degrees W. 6.5 poles to the Beginning, Together with all and singular, the premises, thereunto belonging, or in anywise appertaining: to have and to hold the land hereby conveyed, and the appurtenances unto the said James Simpson his heirs and assigns forever: and the said Philip Hathaway Jr & Sally his wife for themselves , their heirs or assigns against the claim of all person or persons, whatsoever, claiming the same by through or under them, do and will warrant and defend but for from nor against the claim or claims of any other person or persons whatsoever. In witness whereof the said Philip Hathaway Jr & Sally his wife have hereunto set their hands, and seals the day and date first above written. Acknowledged in the presence of Philip Hathaway (seal) Geo L Hampton DC Sally Hathaway (seal) Commonwealth of Kentucky Montgomery County to wit: I Micajah Harrison Clerk of the County Court for the County aforesaid do certify that the foregoing deed from Philip Hathaway Jr and Sally Hathaway his wife to James Simpson Jr was this day produced to me in my office and acknowledged by the said Philip Hathaway Jr to be his act and deed.- And the said Sally Hathaway being examined by me privily and apart from her husband declared that she did freely and willingly seal and deliver the said writing and wishes not to retract it and acknowledged the said writing again shown and explained to her to be her act and deed, and consenteth that the same may be recorded whereupon the said deed together with the foregoing certificate hath been duly admitted to record in my office- Given under my….
