Shirley Indenture: William & Sally Smith Nelson to Matthew Thomson: Montgomery County KY Date: 26 May 1825 Deed Book 12 Page 9,10 This Indenture made this Twenty sixth day of May in the year of our Lord one thousand eight hundred and twenty five Between William Nelson and Sally his wife late Sally Smith of the county of Montgomery and State of Kentucky of the one part and Matthew Thomson of the county of Clark and State aforesaid of the other part Winesseth that the said William Nelson and Sally his wife for and in consideration of the sum of two hundred and fifty Dollars current money of Kentucky to them in hand paid the receipt whereof they do hereby acknowledge have granted Bargained and sold and by these presents do grant Bargain and sell alien and Confirm, to the said Matthew Thomson his heirs and assigns their undivided Interest in and to all that tract or parcel of land situate in the aforesaid County of Montgomery and State aforesaid, on the waters of Brush creek and Sycamore, Granted to William Haynie (who was Grand father to the said Sally)by patent bearing date the second day of December 1785, containing two thousand five hundred acres and is Bounded as follows towit, Beginning at two white oaks (Now fallan) Seven hundred and fifty poles west from the sycamore mentioned in the entry, Southwest comes to another survey made on the same entry, and extending west seven hundred and fifty poles to three cherry trees Locust and hackberry (now fallen) thence North five hundred and thirty three and a third poles to a hickory and sugartree, thence east seven hundred and fifty poles to two Sugartrees, and hickory, comes to the other survey thence south with the line thence five hundred and thirty three and a third poles to the Beginning, together with all and Singular the premises thereunto belonging or in any wise appurtaining to have and to hole the land hereby conveyed, with appurtinances unto the said Matthew Thomson and his heirs or assigns forever: and the Said William Nelson and Sally his wife for themselves and their heirs executors and Administrators their Interest in the aforesaid tract of land and premises unto the said Matthew Thomson and his Heirs or assigns, against the claim or claims of themselves and Their Hiers, and of all persons claiming or to claim by throrugh or under them or either of them Doth and will warrant and forever defend by these presents but from or against no other person or claim Whatsoever. In Witness whereof the said William Nelson and sally his wife have Thereunto set their hands seals this day and date first above written William Nelson (seal) Signed Sealed and acknowledged in presence of Sally Nelson (seal) M V Harrison C.C. State of Kentucky Montgomery County Court Clerks office may 26th 1825 I Micajah V Harrison Deputy clerk for Micajah C Harrison Clerk of the Court for the County aforesaid. Do certify that the within Deed of conveyance from William Nelson and Sally his wife to Matthew Thompson was this day produced to me in the office aforesaid and acknowledged by the said William Nelson to be his act and deed hand and seal for the purposes therein named, and the said Sally Nelson wife of the said William Nelson being by me examined privily and apart from her said husband did declare that she did on the day of the date of said Deed freely and Willingly seal and deliver the said writing which I then show, and explained to her and that she wished not to retract it and the said Sally now before me acknowledged the said writing again Shewn to her to be her act and Deed hand and Seal for the purposes therein named and the same is ordered to be Recorded which is duly done in said office.
